BILL NUMBER: S1902 SPONSOR: AKSHAR TITLE OF BILL: An act to amend chapter 58 of the laws of 2005, relating to authorizing reimbursements for expenditures made by or on behalf of social services districts for medical assistance for needy persons and the adminis- tration thereof; and to amend the general municipal law, in relation to county property tax levy reduction resulting from medical assistance program expenditure reductions PURPOSE OR GENERAL IDEA OF BILL: A five-year state takeover of local Medicaid expenses for cities with a population of one million or less. The bill also requires any share of payments that are reduced or eliminated as a result in federal or state statue be applied as an equal dollar amount reduction in the property tax levy of such county. AKSHAR -- read twice and ordered printed, and when printed to be committed to the Committee on Cities 2 AN ACT to amend chapter 58 of the laws of 2005, relating to authorizing reimbursements for expenditures made by or on behalf of social services districts for medical assistance for needy persons and the administration thereof; and to amend the general municipal law, in relation to county property tax levy reduction resulting from medical assistance program expenditure reductions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1 of part C of chapter 58 of the laws of 2005, relating to authorizing reimbursements for expenditures made by or on behalf of social services districts for medical assistance for needy persons and the administration thereof, is amended by adding a new subdivision (c-2) to read as follows: (C-2) NOTWITHSTANDING ANY PROVISIONS OF SUBDIVISIONS (C) AND (C-1) OF THIS SECTION TO THE CONTRARY, EFFECTIVE APRIL 1, 2022, FOR THE PERIOD JANUARY 1, 2022 THROUGH DECEMBER 31, 2022 AND FOR EACH CALENDAR YEAR THEREAFTER, THE MEDICAL ASSISTANCE EXPENDITURE AMOUNT FOR THE SOCIAL SERVICES DISTRICT FOR SUCH PERIOD SHALL BE THE GREATER OF (I) ZERO; OR (II) THE PREVIOUS CALENDAR YEAR'S MEDICAL ASSISTANCE EXPENDITURE AMOUNT MINUS 20% OF THE MEDICAL ASSISTANCE EXPENDITURE AMOUNT FOR THE PERIOD JANUARY 1, 2021 THROUGH DECEMBER 31, 2022, EXCEPT THAT FOR THE PERIOD JANUARY 1, 2022 THROUGH DECEMBER 31, 2022, THE PREVIOUS CALENDAR YEAR MEDICAL ASSISTANCE EXPENDITURE AMOUNT WILL BE UNCHANGED. THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO ANY SOCIAL SERVICES DISTRICT CONTAINING A CITY HAVING A POPULATION OF ONE MILLION OR MORE. § 2. The general municipal law is amended by adding a new section 3-d to read as follows: § 3-D. COUNTY PROPERTY TAX LEVY REDUCTION RESULTING FROM MEDICAL ASSISTANCE PROGRAM EXPENDITURE REDUCTIONS. NOTWITHSTANDING ANY OTHER EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
