BILL NUMBER: S2879 SPONSOR: RAMOS TITLE OF BILL: An act to amend the executive law, in relation to defining employees of the state PURPOSE: This bill revises that law to define all workersof an elected state official as state employees, and, therefore, holdsthe stateliable for ignoring complaints of workplace abuse. SUMMARY OF PROVISIONS: Section 1. Subdivision 6 of section 292 of the executive law, as amended by chapter 481 of the laws of 2010, is amended: the term "employee" (a)statewide elected officials, including the Governor, Lieutenant Governor, Comptroller and Attorney General.

RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the executive law, in relation to defining employees of the state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 292 of the executive law, as amended by chapter 481 of the laws of 2010, is amended to read as follows: 6. The term "employee" in this article does not include any individual employed by his or her parents, spouse or child, or in the domestic service of any person except as set forth in section two hundred nine- ty-six-b of this [title] ARTICLE; PROVIDED, HOWEVER, THAT FOR THE PURPOSES OF THIS ARTICLE, THE FOLLOWING SHALL BE DEEMED EMPLOYEES OF THE STATE: (A) STATEWIDE ELECTED OFFICIALS, INCLUDING THE GOVERNOR, LIEUTENANT GOVERNOR, COMPTROLLER, AND ATTORNEY GENERAL; (B) STATE OFFICERS AND EMPLOYEES, INCLUDING: (I) HEADS OF STATE DEPARTMENTS AND THEIR DEPUTIES AND ASSISTANTS WHO SERVE AT THE DISCRETION OF A STATEWIDE ELECTED OFFICIAL; AND (II) OFFICERS AND EMPLOYEES OF STATEWIDE ELECTED OFFICIALS WHO SERVE AT THE DISCRETION OF THE STATEWIDE ELECTED OFFICIAL; (C) LEGISLATIVE EMPLOYEES, INCLUDING OFFICERS AND EMPLOYEES OF THE LEGISLATURE; AND (D) LEGISLATIVE MEMBERS, INCLUDING SENATORS AND MEMBERS OF THE ASSEM- BLY. § 2.
