BILL NUMBER: S3292 SPONSOR: RAMOS TITLE OF BILL: An act to amend the labor law, in relation to employer provided sick leave for purposes of receiving the COVID-19 vaccination; and providing for the repeal of such provisions upon the expiration thereof PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to provide sick leave for the purposes of receiving the COVID-19 vaccination. SUMMARY OF PROVISIONS: Section 1 amends Section 196-b of the Labor Law to provide that the provisions of such section shall apply to leave taken for the purposes of receiving the COVID-19 vaccination for four hours of paid leave for each of two appointments for such vaccination, except in the case of an employer covered by the provisions of paragraph a of subdivision one of

RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to employer provided sick leave for purposes of receiving the COVID-19 vaccination; and provid- ing for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 196-b of the labor law is amended by adding a new subdivision 15 to read as follows: 15. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, THE PROVISIONS OF THIS SECTION SHALL APPLY TO LEAVE TAKEN FOR THE PURPOSES OF RECEIVING THE COVID-19 VACCINATION FOR FOUR HOURS OF PAID LEAVE FOR EACH OF TWO APPOINTMENTS FOR SUCH VACCINATION, EXCEPT IN THE CASE OF AN EMPLOYER COVERED BY THE PROVISIONS OF PARAGRAPH A OF SUBDIVISION ONE OF THIS SECTION, THE LEAVE SHALL BE UNPAID, AND PROVIDED THAT ALL OTHER PROVISIONS OF THIS SECTION SHALL APPLY TO SUCH LEAVE. § 2. This act shall take effect immediately and shall expire and be deemed repealed December 31, 2022. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
