TITLE OF BILL:

An act to amend the administrative code of the city of New York and
chapter 53 of the laws of 2012, enacting the aid to localities budget,
in relation to substance abuse prevention personnel in New York city
schools

 
PURPOSE:

To guarantee that the NYC Department of Education shall provide on a
full time basis at least one substance prevention and intervention
specialist at each public school. A substance abuse prevention and
intervention specialist is a New York City department of education
employee that has received substance abuse training through the NYS
Office of Alcoholism and Substance Abuse Services.

 
SUMMARY OF PROVISIONS:

Section One of the Administrative Code of the City of New York is
amended by adding a new Section 12-140.

JUSTIFICATION:

Substance Abuse Prevention and Intervention Specialists (SAPIS) serve an
indispensable function in New York City Schools. Trained to deal with
the effects and causes of emotional, physical, and substance abuse,
SAPIS counselors fill a role that other Department of Education employ-
ees simply cannot.

SAPIS counselors prevent and eliminate many forms of disruptive behavior
that hinders a student's ability to learn and the teacher's ability to
teach. Negative behavioral traits often develop as a result of abuse in
a student's family. Drug abuse among the children of drug abusers is not
uncommon. These children also frequently develop violence-prone person-
alities and a sharp decline in academic performance. SAPIS workers are
our best tools for stemming these trends.

Bolstering the SAPIS program will lead to a long-term decrease in New
York State's financial obligations. In short, SAPIS has been proven to
shepherd students front high risk to productive members of society. The
Passage of this bill will ensure that at least one full time substance
abuse prevention and intervention specialist be assigned to each NYC
Public School.

 AN ACT to amend the administrative code of the  city  of  New  York  and
   chapter 53 of the laws of 2012, enacting the aid to localities budget,
   in  relation  to substance abuse prevention personnel in New York city
   schools

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The administrative code of the city of New York is amended
 by adding a new section 12-141 to read as follows:
   § 12-141 SUBSTANCE ABUSE PREVENTION AND INTERVENTION PERSONNEL.    THE
 NEW YORK CITY DEPARTMENT OF EDUCATION SHALL PROVIDE ON A FULL-TIME BASIS
 AT  LEAST  ONE SUBSTANCE ABUSE PREVENTION AND INTERVENTION SPECIALIST AT
 EACH PUBLIC SCHOOL IN THE CITY OF NEW YORK. FOR  THE  PURPOSES  OF  THIS
 SECTION,  A  SUBSTANCE ABUSE PREVENTION AND INTERVENTION SPECIALIST IS A
 NEW YORK  CITY  DEPARTMENT  OF  EDUCATION  EMPLOYEE  THAT  HAS  RECEIVED
 SUBSTANCE  ABUSE TRAINING THROUGH THE NEW YORK STATE OFFICE OF ADDICTION
 SERVICES AND SUPPORTS.
   § 2. Section 1 of chapter 53 of the laws of 2012, enacting the aid  to
 localities  budget,  is  amended  by repealing the items hereinbelow set
 forth in brackets and by adding to such section the other  items  under-
 scored in this section.

           OFFICE OF [ALCOHOLISM AND SUBSTANCE ABUSE] ADDICTION
                           SERVICES AND SUPPORTS
 
 PREVENTION AND PROGRAM SUPPORT

 Notwithstanding  any provision of law to the
   contrary, the commissioner of  the  office
   of   [alcoholism   and   substance  abuse]
   ADDICTION services AND SUPPORTS shall  [be
   authorized  to  continue  contracts  which
   were executed on or before March 31,  2012
   with entities providing services for prob-
   lem   gambling   and  chemical  dependency
   prevention and treatment services, without
   any  additional  requirements  that   such
   contracts   be   subject   to  competitive
   bidding, a request for proposal process or
   other administrative procedures.   Of  the
   amounts   appropriated  herein,  at  least
   $14,859,531 shall be  made]  MAKE  FUNDING
   available  to the New York City Department
   of Education for the continuation of  such
   school-operated     prevention    programs
   provided by  school  district  [employees]

   § 3. This act shall take effect immediately.
