S T A T E O F N E W Y O R K ________________________________________________________________________ 3637 2021-2022 Regular Sessions I N S E N A T E January 30, 2021 ___________ Introduced by Sen. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the definition of person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 125.05 of the penal law, the section heading, open- ing paragraph and closing paragraph as amended by chapter 1 of the laws of 2019, is amended to read as follows: § 125.05 Homicide and related offenses; definition. The following definition is applicable to this article: "Person," when referring to the victim of a homicide, means a human being who has been born and is alive. THIS PROVISION SHALL BE KNOWN AS "MYA'S LAW". § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
