BILL NUMBER: S3976 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the education law, in relation to providing a program fee option for graduate students PURPOSE OR GENERAL IDEA OF BILL: Provides for the trustees of the state university to establish an access fee option for graduate and doctoral students, while exempting those from teaching and research responsibilities from the fee. SUMMARY OF SPECIFIC PROVISIONS: Paragraph h of subdivision 2 of section 355 of the education law is amended by adding a new subparagraph 11. This bill would require the trustees of the state university to adopt an access fee option in the exercise of their power to regulate tuition charges. STAVISKY, ADDABBO, BAILEY, BENJAMIN, BIAGGI, BORREL- LO, BOYLE, GALLIVAN, GAUGHRAN, GOUNARDES, HOYLMAN, JACKSON, KAPLAN, KENNEDY, KRUEGER, LIU, MAY, MAYER, MYRIE, RIVERA, SALAZAR, SAVINO, SEPULVEDA, SERRANO, THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to providing a program fee option for graduate students THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph h of subdivision 2 of section 355 of the educa- tion law is amended by adding a new subparagraph 11 to read as follows: (11) THE TRUSTEES SHALL ALSO ESTABLISH AN ACCESS FEE OPTION THAT WOULD ALLOW A STUDENT WHO IS A CANDIDATE FOR A GRADUATE OR PROFESSIONAL DEGREE AND HAS COMPLETED AT LEAST THIRTY CREDITS, AND IS ON LEAVE FROM FULL- TIME STUDY, TO MAINTAIN ACCESS TO CERTAIN FACILITIES WITHIN THE STATE UNIVERSITY SUCH AS LIBRARIES, COMPUTERS AND/OR STUDENT CENTERS IN ORDER TO CONTINUE A RESEARCH PROJECT OR TO PURSUE OTHER ACADEMIC REQUIREMENTS ESTABLISHED BY THE STATE UNIVERSITY, WITHOUT BEING ENROLLED IN REGULAR CREDIT COURSES. SUCH FEE SHALL NOT EXCEED THE COST OF ONE CREDIT OF THE STUDENT'S PROGRAM OF GRADUATE OR DOCTORATE COURSE WORK AS ESTABLISHED BY THE TRUSTEES OF THE STATE UNIVERSITY. ALL CURRENT AND FUTURE MANDATORY UNIVERSITY FEES, WITH THE EXCLUSION OF THE GRADUATE STUDENT ASSOCIATION STUDENT ACTIVITY FEE, SHALL NOT BE CHARGED TO A GRADUATE STUDENT SERVING A FULL-TIME OR HALF-TIME APPOINTMENT AS A GRADUATE TEACHING ASSISTANT, GRADUATE ASSISTANT, GRADUATE RESEARCH ASSISTANT, GRADUATE RESEARCH ASSO- CIATE, OR GRADUATE TEACHING ASSOCIATE.
