BILL NUMBER: S4224 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the penal law, in relation to assault in the third degree PURPOSE: This bill codifies penalties for those who intentionally injure an oper- ator or passenger of a vehicle for hire or public transportation. This bill would cover taxi drivers and passengers as well as operators and passengers using other means of public transportation. SUMMARY OF PROVISIONS: Section one of this bill renumbers subdivision 3 of penal law section 120.00 to subdivision 4 and a new subdivision 3 is added. STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to assault in the third degree THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 120.00 of the penal law is renum- bered subdivision 4, and a new subdivision 3 is added to read as follows: 3. HE OR SHE CAUSES PHYSICAL INJURY TO AN OPERATOR, DRIVER, OR PASSEN- GER ON A BUS, TAXICAB, AERIAL TRAMWAY, SUBWAY, OR OTHER MOTOR VEHICLE, USED FOR THE TRANSPORTATION OF PERSONS FOR HIRE, OR TO A SCHOOL BUS DRIVER, A STATION AGENT OR TICKET AGENT FOR THE ENTITY PROVIDING THE TRANSPORTATION, AND HE OR SHE KNOWS OR REASONABLY SHOULD KNOW THAT THE VICTIM, IN THE CASE OF AN OPERATOR, DRIVER, OR AGENT, IS ENGAGED IN THE PERFORMANCE OF HIS OR HER DUTIES, OR IS A PASSENGER; OR § 2.
