BILL NUMBER: S4712 SPONSOR: PALUMBO TITLE OF BILL: An act to amend the public health law and the environmental conservation law, in relation to 1,4-Dioxane levels PURPOSE: To establish a maximum containment level of 0.35 parts per billion for the presence of 1,4-Dioxane level in public supplies of potable water, ground water and runoff water from a waste water or water supply treat- ment plant. SUMMARY OF PROVISIONS: Section 1. The commissioner shall establish a maximum contaminant level of 0.35 parts per billion for the presence of E4-Dioxane in public supplies of potable water. PALUMBO -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law and the environmental conservation law, in relation to 1,4-Dioxane levels THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 1100-b to read as follows: § 1100-B. 1,4-DIOXANE. 1. THE COMMISSIONER SHALL ESTABLISH A MAXIMUM CONTAMINANT LEVEL OF 0.35 PARTS PER BILLION FOR THE PRESENCE OF 1,4-DIOXANE IN PUBLIC SUPPLIES OF POTABLE WATER. 2. SUCH STANDARD FOR 1,4-DIOXANE SHALL BE IMPLEMENTED IN ACCORDANCE WITH DEPARTMENT REGULATIONS AND THE STATE ADMINISTRATIVE PROCEDURE ACT AND BE COMPLETED AS SOON AS PRACTICABLE, INCLUDING IMPLEMENTATION BY EMERGENCY RULE IF DETERMINED BY THE COMMISSIONER AS NECESSARY TO PROTECT PUBLIC HEALTH. § 2. The environmental conservation law is amended by adding a new section 17-0307 to read as follows: § 17-0307. 1,4-DIOXANE. 1. THE DEPARTMENT, IN CONSULTATION WITH THE DEPARTMENT OF HEALTH, SHALL ESTABLISH A MAXIMUM CONTAMINANT LEVEL OF 0.35 PARTS PER BILLION FOR THE PRESENCE OF 1,4-DIOXANE IN GROUND WATER AND RUNOFF WATER FROM A WASTEWATER TREATMENT PLANT OR WATER SUPPLY TREATMENT PLANT. 2. SUCH STANDARD FOR 1,4-DIOXANE SHALL BE IMPLEMENTED IN ACCORDANCE WITH DEPARTMENT REGULATIONS AND THE STATE ADMINISTRATIVE PROCEDURE ACT AND BE COMPLETED AS SOON AS PRACTICABLE, INCLUDING IMPLEMENTATION BY EMERGENCY RULE IF DETERMINED BY THE COMMISSIONER AS NECESSARY TO PROTECT PUBLIC HEALTH. § 3.
