BILL NUMBER: S4726 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the election law, in relation to prohibiting fraudulent absentee ballot drop-off boxes or receptacles PURPOSE: To amend the Election Law to prohibit any person or entity, other that the Board of Elections from erecting, displaying or maintaining an absentee ballot drop-off box or receptacle. . SUMMARY OF PROVISIONS: Section 1 creates a new section of the Election Law, 17-172, which provides that a person or entity, other than Board of Elections, who erects, displays or maintains an absentee ballot drop off box or recep- tacle is guilty of a felony.

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to prohibiting fraudulent absentee ballot drop-off boxes or receptacles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The election law is amended by adding a new section 17-172 to read as follows: § 17-172. ABSENTEE BALLOT DROP-OFF FRAUD. ANY PERSON OR ENTITY, OTHER THAN THE BOARD OF ELECTIONS, WHO ERECTS, DISPLAYS OR MAINTAINS AN ABSEN- TEE BALLOT DROP-OFF BOX OR RECEPTACLE IS GUILTY OF A FELONY. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD05959-01-1
