TITLE OF BILL:

An act to amend the environmental conservation law, in relation to
directing the commissioner to publicly publish the annual report of the
environmental radiation surveillance program

 
PURPOSE:

Directs the commissioner to publicly publish the annual report of the
environmental radiation surveillance program

 
SUMMARY OF PROVISIONS:

Section 1 amends subdivision 1 of section 3-0301 of the environmental
conservation law by adding paragraph ii which directs the commissioner
to provide freely and make publicly available on its website the annual
report on radioactive releases or disposals, submitted pursuant to 6
NYCRR380.

Section 2 states the effective date.

 
JUSTIFICATION:

According to the Department of Health, the environmental radiation
surveillance program measures the level of radionuclides in environ-
mental media to determine the normal levels (background) of radioactivi-
ty at several locations in the State and monitors the influence of human
activities on these levels.

The direct gamma radiation monitoring component of the Environmental
Radiation Surveillance Program measures radiation levels in the environ-
ment at several locations in the State. This is accomplished by deploy-
ing Environmental Thermoluminescent Dosimeters (TLDs). The Environmental
TLDs provide quantitative measurements of the radiation levels in the
areas in which they are placed. Environmental TLDs are typically
deployed for approximately one calendar quarter and processed or sent
for processing, as appropriate.  This legislation directs the commis-
sioner to make the annual report on radioactive releases or disposals,
submitted pursuant to 6 NYCRR380 available on their website.

 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   directing  the  commissioner  to publicly publish the annual report of
   the environmental radiation surveillance program

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  1  of  section  3-0301  of the environmental
 conservation law is amended by adding a new  paragraph  ii  to  read  as
 follows:
   II.  PROVIDE  FREELY  AND  MAKE  PUBLICLY AVAILABLE ON ITS WEBSITE THE
 ANNUAL REPORT ON RADIOACTIVE RELEASES OR DISPOSALS,  SUBMITTED  PURSUANT
 TO  6  NYCRR  380.    IN CONJUNCTION WITH THE DEPARTMENT OF HEALTH, SUCH
 REPORT SHALL BE ANALYZED TO SHOW TRENDS AND  THE  CUMULATIVE  IMPACT  OF
 SUCH  RADIOACTIVE  RELEASES  OR  DISPOSALS; PROVIDED THAT OTHER RELEVANT
 AGENCIES SHALL BE NOTIFIED IF CONTAMINATION HAS EXCEEDED  STANDARDS  FOR
 MAXIMUM  ALLOWABLE LEVEL PERMITTED IN DRINKING WATER OR FOOD SOURCES, AS
 PRESCRIBED BY THE U.S. ENVIRONMENTAL PROTECTION AGENCY.
