TITLE OF BILL:

An act to amend the public health law, in relation to requiring hospi-
tals distribute literature created by the commissioner to patients at a
high risk of sickle cell disease

 
PURPOSE:

Requires hospitals distribute literature created by the commissioner to
patients at a high risk of sickle cell disease

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 amends the public health law by adding a new section 2803-z
relating to Sickle Cell Disease information distribution.

Section 2 amends subdivision 1 of section 207 the public health law by
adding a new paragraph which includes Sickle Cell Disease in the Depart-

ment of Health's health care and wellness education and outreach
program.

Section 3 provides the effective date.

 
JUSTIFICATION:

Education is an easy and inexpensive way to prevent and treat disease.
Sickle cell disease is common among Americans, yet many are not aware of
the disease and how certain groups are more at risk of having the trait
that could then result in their children having sickle cell.  The
government has already made steps towards getting the public educated by
requiring that all infants get screened for sickle cell, but everyone
born before 2006 does not have that same advantage'. An informational
packet for patients at high risk of developing sickle cell is necessary
and would be advantageous to Americans as well as the Medicaid program
that covers patients who do have sickle cell.

This brochure distribution in addition to the creation of an advisory
council made up of people actually suffering from the disease will give
a voice to underrepresented groups. These groups can deal with a multi-
tude of hardships, being in chronic pain is not visible and it is possi-
ble that some institutions will not believe patients who are struggling.
Being well informed about a disease that you may or do have is not a
privilege, it should be a right, and that is what this bill establishes.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  public health law is amended by adding a new section
 2803-z to read as follows:
   § 2803-Z. SICKLE CELL DISEASE INFORMATION  DISTRIBUTION.  THE  COMMIS-
 SIONER  SHALL  DESIGN AN INFORMATIONAL PACKET ABOUT SICKLE CELL DISEASE,
 INCLUDING SCREENING, PREVENTION, AND TREATMENT INFORMATION. EVERY GENER-
 AL HOSPITAL SHALL DISTRIBUTE THE PACKET TO EVERY  PATIENT,  OR,  IF  THE
 PATIENT  LACKS  CAPACITY  TO MAKE HEALTH CARE DECISIONS, TO A PERSON WHO
 HAS AUTHORITY TO MAKE HEALTH CARE  DECISIONS  FOR  THE  PATIENT  WHO  IS
 SUSPECTED TO BE AT HIGH RISK OF INHERITING SICKLE CELL DISEASE.
   §  2. Subdivision 1 of section 207 of the public health law is amended
 by adding a new paragraph (p) to read as follows:
   (P) SICKLE CELL  DISEASE  INCLUDING  BUT  NOT  LIMITED  TO  SCREENING,
 PREVENTION,  AND  TREATMENT  INFORMATION.  THE  PROGRAM SHALL INCLUDE AN
 ADVISORY COUNCIL UNDER THIS SECTION THAT  SHALL  INCLUDE  PATIENTS  WITH
 SICKLE  CELL  DISEASE  AND  THEIR  FAMILIES  AND  HEALTH  CARE PROVIDERS
 SPECIALIZING IN TREATING SICKLE CELL DISEASE, AMONG OTHERS.
   § 3. This act shall take effect immediately.
