BILL NUMBER: S5961 SPONSOR: REICHLIN-MELNICK TITLE OF BILL: An act to amend the estates, powers and trusts law, in relation to authorizing the fiduciary of a decedent to take control of certain web site accounts of the decedent PURPOSE: To authorize the fiduciary of a decedent to take control of certain website accounts of the decedent. SUMMARY OF PROVISIONS: Section 1. Allows a loved one or family member to take control of, conduct, continue, or terminate a social networking web site, microblog- ging, or other account after an individual has passed away, if author- ized by a will.

REICHLIN-MELNICK -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the estates, powers and trusts law, in relation to authorizing the fiduciary of a decedent to take control of certain web site accounts of the decedent THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of section 11-1.1 of the estates, powers and trusts law is amended by adding a new subparagraph 23 to read as follows: (23) UNLESS EXPRESSLY PROHIBITED BY THE WILL OR COURT ORDER, TO TAKE CONTROL OF, CONDUCT, CONTINUE OR TERMINATE ANY ACCOUNT OF THE DECEDENT ON ANY SOCIAL NETWORKING WEB SITE, MICROBLOGGING OR SHORT MESSAGE SERVICE WEB SITE OR EMAIL SERVICE WEB SITE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD08278-01-1
