BILL NUMBER: S5970 SPONSOR: PARKER TITLE OF BILL: An act to amend the general business law, in relation to the manufactur- ing of portable electronic devices PURPOSE OR GENERAL IDEA OF BILL: This Bill would require mobile device manufacturers to install ATSC 3.0 chips in mobile devices sold in New York. The Bill will greatly enhance safety and emergency communications because New Yorkers would be able to receive more robust emergency alerts and notifications directly on their mobile devices. SUMMARY OF PROVISIONS: Amends the General Business Law to create a new article 40, Portable Electronic Devices. PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to the manufactur- ing of portable electronic devices THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new article 40 to read as follows: ARTICLE 40 PORTABLE ELECTRONIC DEVICES SECTION 900. MANUFACTURING REQUIREMENTS. § 900. MANUFACTURING REQUIREMENTS. 1. FOR THE PURPOSES OF THIS SECTION, "PORTABLE ELECTRONIC DEVICE" SHALL MEAN ANY HAND-HELD MOBILE TELEPHONE, AS DEFINED BY SUBDIVISION ONE OF SECTION TWELVE HUNDRED TWEN- TY-FIVE-C OF THE VEHICLE AND TRAFFIC LAW, PERSONAL DIGITAL ASSISTANT (PDA), OR HANDHELD DEVICE WITH MOBILE DATA ACCESS. 2. ON AND AFTER JANUARY FIRST, TWO THOUSAND TWENTY-THREE, NO MANUFAC- TURER SHALL PROVIDE FOR SALE IN THIS STATE ANY PORTABLE ELECTRONIC DEVICE NOT EQUIPPED WITH AN ATSC 3.0 CHIP. § 2.
