BILL NUMBER: S6020 SPONSOR: THOMAS TITLE OF BILL: An act to amend the public health law, in relation to pharmacy benefit managers PURPOSE OR GENERAL IDEA OF BILL: This bill requires pharmacy benefit managers to reimburse pharmacies no less than their acquisition costs for prescription drugs. SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends Public Health Law 6 280-a to add new defi- nitions for "pharmacy acquisition cost," "pharmacy benefit manager affiliate," and "pharmacy benefits plan or program." The bill also allows a pharmacy to appeal a dispute regarding generic drug pricing, including reimbursement below the pharmacy acquisition

THOMAS -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to pharmacy benefit managers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 280-a of the public health law, as added by chapter 540 of the laws of 2015, subdivisions 3 and 4 as added by section 2 of part MM of chapter 57 of the laws of 2018, is amended to read as follows: § 280-a. Pharmacy benefit managers. 1. Definitions. As used in this section, the following terms shall have the following meanings: (a) "Pharmacy benefit manager" means an entity that contracts with pharmacies or pharmacy contracting agents on behalf of a health plan, state agency, insurer, managed care organization, or other third party payor to provide pharmacy health benefit services or administration. (b) "Maximum allowable cost price" means a maximum reimbursement amount set by the pharmacy benefit manager for therapeutically equiv- alent multiple source generic drugs. (C) "PHARMACY ACQUISITION COST" MEANS THE AMOUNT THAT A PHARMACEUTICAL WHOLESALER CHARGES FOR A PHARMACEUTICAL PRODUCT AS LISTED ON THE PHARMA- CY'S BILLING INVOICE. (D) "PHARMACY BENEFIT MANAGER AFFILIATE" MEANS A PHARMACY OR PHARMA- CIST THAT DIRECTLY OR INDIRECTLY, THROUGH ONE OR MORE INTERMEDIARIES OWNS OR CONTROLS, IS OWNED OR CONTROLLED BY, OR IS UNDER COMMON OWNER- SHIP OR CONTROL WITH A PHARMACY BENEFIT MANAGER. (E) "PHARMACY BENEFITS PLAN OR PROGRAM" MEANS A PLAN OR PROGRAM THAT PAYS FOR, REIMBURSES, COVERS THE COST OF, OR OTHERWISE PROVIDES FOR PHARMACIST SERVICES TO INDIVIDUALS WHO RESIDE IN OR ARE EMPLOYED IN THIS STATE.
