Provides that a person designated as a candidate for two or more party nominations for an office to be filled at the time of a general election who is not nominated at a primary election by one or more such parties may decline the nomination of one or more parties not later than ten days after the primary election.

 AN ACT to amend the election law, in relation to declining  party  nomi-
   nations after primary elections

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 6-158 of the election law is amended  by  adding  a
 new subdivision 15 to read as follows:
   15.  (A)  A  PERSON  WHO HAS BEEN DESIGNATED FOR NOMINATION FOR PUBLIC
 OFFICE BY ANY PARTY OR PARTIES AND WHO THEREAFTER DOES NOT  RECEIVE  ONE
 OR  MORE  SUCH NOMINATIONS MAY DECLINE ANY NOMINATION OR NOMINATIONS FOR
 SUCH OFFICE BY FILING A CERTIFICATE OF DECLINATION NOT  LATER  THAN  THE
 FIFTEENTH DAY AFTER THE PRIMARY ELECTION.
   (B)  A  CERTIFICATE TO FILL  A VACANCY BY DECLINATION PURSUANT TO THIS
 SUBDIVISION SHALL BE FILED NOT LATER THAN TWENTY DAYS AFTER SUCH  DECLI-
 NATION HAS BEEN FILED.
   §  2. This act shall take effect on the first of January next succeed-
 ing the date on which it shall have become a law.

 AN ACT to amend the election law, in relation to candidate declination
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 6-146 of the election law is amended  by  adding  a
 new subdivision 6 to read as follows:
   6.  A  PERSON  DESIGNATED  AS  A CANDIDATE FOR TWO OR MORE PARTY NOMI-
 NATIONS FOR AN OFFICE TO BE FILLED AT THE TIME OF A GENERAL ELECTION WHO
 IS NOT NOMINATED AT A PRIMARY ELECTION BY ONE OR MORE SUCH  PARTIES  MAY
 DECLINE  THE  NOMINATION  OF ONE OR MORE PARTIES NOT LATER THAN TEN DAYS
 AFTER THE PRIMARY ELECTION.
   § 2. This act shall take effect immediately.
