TITLE OF BILL:

An act to amend the vehicle and traffic law, in relation to establishing
a residential parking system in the village of South Nyack, or its
successor municipality

 
PURPOSE:

To establish a residential parking system in the village of South Nyack.

 
SUMMARY OF PROVISIONS:

Section 1. Establishes a residential permit parking system in the
village of South Nyack at the discretion of the board of trustees of the
village of South Nyack or its successor municipality that would be in
effect on weekends and holidays between April 1st and October 31st. This
section also details roadways that would be included in the residential
parking permit system and sets parameters for what the local law or
ordinance should outline when the residential parking system is estab-

lished. Such parameters include: registering motor vehicles, providing
times of day and days of the week that permits shall be in effect,
providing short term parking, and spaces for nonresidents, requiring
metered payment as well as allowing app-based payment, providing a sche-
dule of fees to be paid for such permits, and distributes funds to the
village of South Nyack or success municipality. Lastly, this section
provides that the residential permit parking system cannot be adopted
until a public hearing on the matter is held.

Section 2. Establishes an effective date.

 
JUSTIFICATION:

The village of South Nyack has requested this bill because of the recent
opening of the public bike and pedestrian shared use path (SUP) running
along the Gov. Mario M. Cuomo/new Tappan Zee Bridge.  The path's opening
has added significant traffic to residential streets surrounding the
Rockland entrance of the SUP according to village officials. While
enjoying the pedestrian path, these visitors park in residential areas
nearby, which causes hardship for South Nyack who want to use limited
parking spaces on their streets. This bill would create a residential
permit parking program that would allow the village to charge non-resi-
dents who are using the SUP and encourage them to park in official park-
ing areas for the SUP, while allowing residents to have priority on
local streets.

 AN ACT to amend the vehicle and traffic law, in relation to establishing
   a residential parking system in the village of  South  Nyack,  or  its
   successor municipality

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The vehicle and traffic law is  amended  by  adding  a  new
 section 1662-f to read as follows:
   §  1662-F. RESIDENTIAL PARKING SYSTEM IN THE VILLAGE OF SOUTH NYACK OR
 ITS SUCCESSOR MUNICIPALITY. 1.   NOTWITHSTANDING THE PROVISIONS  OF  ANY
 LAW  TO  THE  CONTRARY,  THE  BOARD  OF TRUSTEES OF THE VILLAGE OF SOUTH
 NYACK, OR ITS SUCCESSOR MUNICIPALITY, MAY, BY ADOPTION OF A LOCAL LAW OR
 ORDINANCE, PROVIDE FOR A RESIDENTIAL PARKING  PERMIT  SYSTEM  TO  BE  IN
 EFFECT  ON  THE  WEEKENDS  AND  HOLIDAYS BETWEEN APRIL FIRST AND OCTOBER
 THIRTY-FIRST AND FIX AND REQUIRE THE PAYMENT OF FEES APPLICABLE TO PARK-
 ING WITHIN THE AREA IN WHICH SUCH PARKING SYSTEM IS IN EFFECT IN ACCORD-
 ANCE WITH THE PROVISIONS OF THIS SECTION.
   2. SUCH RESIDENTIAL PARKING PERMIT  SYSTEM  MAY  ONLY  BE  ESTABLISHED
 WITHIN THE AREA OF THE VILLAGE CONSISTING OF THE FOLLOWING ROADWAYS:
   (A) S. BROADWAY NORTH FROM FERRIS LANE TO VOORHIS AVENUE;
   (B) DEPOT PLACE NORTH FROM BROOKSIDE TO VOORHIS AVENUE;
   (C) BROOKSIDE AVE FROM COOPER DRIVE EAST TO S. BROADWAY;
   (D) CLINTON AVE FROM COOPER DRIVE EAST TO PIERMONT AVENUE;
   (E) VOORHIS AVENUE FROM DEPOT PLACE EAST TO S. BROADWAY;
   (F) PRALL PLACE FROM S. BROADWAY EAST TO PIERMONT AVENUE;
   (G) WASHINGTON AVENUE FROM S. BROADWAY EAST TO PIERMONT AVENUE;
   (H)  MANSFIELD AVENUE (SOUTH SIDE OF THE STREET) FROM S. BROADWAY EAST
 TO PIERMONT AVENUE;
   (I) CORNELISON AVENUE FROM S. BROADWAY EAST TO PIERMONT AVENUE;
   (J) ALL OF COOPER DRIVE;
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

   (K) ALL OF ELIZABETH PLACE;
   (L) ALL OF HAMILTON PLACE;
   (M) ALL OF LIVINGSTON PLACE; AND
   (N) ALL OF WHITE AVE.
   3. NOTWITHSTANDING THE FOREGOING, NO PERMIT SHALL BE REQUIRED ON THOSE
 PORTIONS  OF  SUCH  STREETS  WHERE THE ADJACENT PROPERTIES ARE ZONED FOR
 COMMERCIAL/RETAIL USE.
   4. THE LOCAL LAW OR ORDINANCE PROVIDING FOR SUCH  RESIDENTIAL  PARKING
 SYSTEM SHALL:
   (A)  SET  FORTH  FACTORS  NECESSITATING  THE ENACTMENT OF SUCH PARKING
 SYSTEM;
   (B) PROVIDE THAT MOTOR VEHICLES REGISTERED PURSUANT  TO  SECTION  FOUR
 HUNDRED  FOUR-A OF THIS CHAPTER SHALL BE EXEMPT FROM ANY PERMIT REQUIRE-
 MENT;
   (C) PROVIDE THE TIMES OF DAY AND DAYS OF THE WEEK DURING WHICH  PERMIT
 REQUIREMENTS SHALL BE IN EFFECT;
   (D) MAKE NOT LESS THAN FIFTEEN PERCENT OF THE SPACES WITHIN THE PERMIT
 AREA  AVAILABLE TO NONRESIDENTS, AND SHALL PROVIDE SHORT TERM PARKING OF
 NOT LESS THAN SIXTY MINUTES IN DURATION IN THE PERMIT AREA;
   (E) REQUIRE THAT SUCH RESIDENTIAL PARKING SYSTEM CANNOT  ONLY  UTILIZE
 AN APP-BASED SYSTEM FOR PAYMENT AND SHALL INCLUDE METERED PAYMENT;
   (F) PROVIDE THE SCHEDULE OF FEES TO BE PAID FOR SUCH PERMITS; AND
   (G)  PROVIDE  THAT  SUCH FEES SHALL BE CREDITED TO THE GENERAL FUND OF
 THE VILLAGE OF SOUTH NYACK, OR ITS SUCCESSOR MUNICIPALITY, UNLESS OTHER-
 WISE SPECIFIED IN SUCH LOCAL LAW.
   5. NO ORDINANCE SHALL BE ADOPTED PURSUANT  TO  THIS  SECTION  UNTIL  A
 PUBLIC  HEARING  THEREON HAS BEEN HAD IN THE SAME MANNER AS REQUIRED FOR
 PUBLIC HEARINGS ON A LOCAL LAW PURSUANT TO THE MUNICIPAL HOME RULE LAW.
   6. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO ANY STATE HIGHWAY
 MAINTAINED BY THE STATE.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law. Effective immediately, the addition,  amend-
 ment and/or repeal of any rule or regulation necessary for the implemen-
 tation  of  this act on its effective date are authorized to be made and
 completed on or before such effective date.
