BILL NUMBER: S6968 SPONSOR: GAUGHRAN TITLE OF BILL: An act to amend the village law, in relation to villages with November elections conducting referenda PURPOSE OR GENERAL IDEA OF BILL: Relates to an act adopted by a November general election village and subject to a referendum on petition. SUMMARY OF SPECIFIC PROVISIONS: Section 1. Amends Section 9-902 of the Village Law to add a new subdivi- sion 6-a. This subdivision clarifies the timing of referenda for villages with November general elections and resolves a conflict between the village law and the election law. Section 2. Severability Clause

GAUGHRAN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law, in relation to villages with November elections conducting referenda THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 9-902 of the village law is amended by adding a new subdivision 6-a to read as follows: 6-A. FOR VILLAGES THAT HOLD THEIR GENERAL ELECTIONS ON THE GENERAL ELECTION DAY IN NOVEMBER, IF SUCH PETITION BE FILED ON OR AFTER THE FIRST DAY OF JUNE AND ON OR BEFORE THE FIRST DAY OF AUGUST, A PROPOSI- TION FOR THE APPROVAL OF SUCH ACT OR RESOLUTION SHALL BE SUBMITTED AT THE GENERAL VILLAGE ELECTION DATE IN NOVEMBER OF THAT YEAR. FOR VILLAGES THAT HOLD THEIR GENERAL ELECTIONS ON THE GENERAL ELECTION DAY IN NOVEMBER, IF SUCH PETITION BE FILED AFTER THE FIRST DAY OF AUGUST AND BEFORE THE FIRST DAY OF JUNE, A PROPOSITION FOR THE APPROVAL OF SUCH ACT OR RESOLUTION SHALL BE SUBMITTED AT THE SPECIAL VILLAGE ELECTION TO BE HELD NOT LESS THAN TEN NOR MORE THAN SIXTY DAYS AFTER THE FILING OF SUCH PETITION. § 2. Severability. If any provision of this act or the application thereof shall for any reason be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder of this act, but shall be confined in its oper- ation to the provision thereof directly involved in the controversy in which such judgment shall have been rendered. § 3.
