BILL NUMBER: S7218 SPONSOR: SERINO TITLE OF BILL: An act to amend the judiciary law, in relation to requiring certain court of appeals judges to recuse themselves from serving as a juror during an impeachment trial of a governor that appointed them PURPOSE: To require judges of the court of appeals appointed by a governor subject to a trial of impeachment to recuse himself or herself from serving on the court for the trial of impeachment. SUMMARY OF PROVISIONS: Section 1: Amends the Judiciary Law by adding a new section 60-a requir- ing judges of the court of appeals appointed by a governor subject to a trial of impeachment to recuse himself or herself from serving on the court for the trial of impeachment.

SERINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the judiciary law, in relation to requiring certain court of appeals judges to recuse themselves from serving as a juror during an impeachment trial of a governor that appointed them THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The judiciary law is amended by adding a new section 60-a to read as follows: § 60-A. RECUSAL AS JUROR DURING IMPEACHMENT TRIAL. ANY JUDGE OF THE COURT OF APPEALS THAT WAS APPOINTED BY THE GOVERNOR SUBJECT TO A TRIAL OF IMPEACHMENT, OUTLINED IN SECTION TWENTY-FOUR OF ARTICLE SIX OF THE STATE CONSTITUTION, SHALL RECUSE HIMSELF OR HERSELF FROM SERVING ON THE COURT FOR THE TRIAL OF IMPEACHMENT. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11804-01-1
