BILL NUMBER: S7281 SPONSOR: KAMINSKY TITLE OF BILL: An act to amend the criminal procedure law, in relation to including acts designated as hate crimes to the definition of designated offense for purposes of eavesdropping and video surveillance warrants PURPOSE: Classifies all hate crimes as designated offenses for the purposes of eavesdropping and video surveillance warrants. SUMMARY OF PROVISIONS: Section 1 adds all hate crimes as designated offenses for eavesdropping and video surveillance warrants. Section 2 sets the effective date.

KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the criminal procedure law, in relation to including acts designated as hate crimes to the definition of designated offense for purposes of eavesdropping and video surveillance warrants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 700.05 of the criminal procedure law is amended by adding a new paragraph (w) to read as follows: (W) ANY OF THE ACTS DESIGNATED AS A HATE CRIME AS DEFINED IN SECTION 485.05 OF THE PENAL LAW. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11860-01-1
