TITLE OF BILL:

An act authorizing the county of Cattaraugus to transfer and convey
reforested lands in the town of Perrysburg to the state of New York

 
PURPOSE OR GENERAL IDEA OF BILL:

To permit the transfer and conveyance of Perrysburg Pond, Crocker's Pond
and Bob's Pond (tax map 2.003-1-20) to the state of New York

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1: Cattaraugus County is authorized to discontinue the use of
certain parcels of reforested land in the town of Perrysburg.

Section 2: The lands authorized to be alienated and conveyed shall be
devoted in perpetuity and without compensation.

Section 3: Lists the lands to be alienated and conveyed.

Section 4: The land to be transferred, and all structures and facilities
situated on such land, shall be maintained, owned and operated for
recreational purposes by the state of New York. The use of such parkland
and facilities shall continue to be made available to the general
public, including all residents of Cattaraugus County.

Section 5: Effective date

 
JUSTIFICATION:

The Cattaraugus County Legislature adopted Resolution No. 251-2021 on
June 9, 2021, requesting that the New York State Legislature adopt
special legislation permitting the transfer and conveyance of Cattarau-
gus County reforestation property to New York State.

The County has explored many options in relation to the property includ-
ing, but not limited to, timber harvest, recreational use, access to the
property and continued maintenance of the property.

It has been determined to be in the county's best interests to transfer
and convey the aforementioned reforestation property to New York State.

 AN ACT authorizing the county of  Cattaraugus  to  transfer  and  convey
   reforested lands in the town of Perrysburg to the state of New York
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding section 219 of the county law, and  subject
 to  the provisions of this act, the county of Cattaraugus acting through
 its legislative body, is hereby authorized to  discontinue  the  use  of
 certain  parcels  of  reforested  land  in  the town of Perrysburg, more
 particularly described in section three of this act, and to enter into a
 contract to convey its interest in such real property to  the  state  of
 New  York,  upon the terms and conditions contained in this act, for use
 by the state of New York.
   § 2. The lands authorized to be alienated  and  conveyed  pursuant  to
 section  one  of  this act, and which are more particularly described in
 section three of this act, shall  be  devoted  in  perpetuity;  and  the
 conveyance  of  such  lands  from  the county to the state shall be done
 without compensation and shall not require the  county  to  acquire  any
 replacement or substitute reforested lands.
   §  3.  The lands authorized to be alienated and conveyed by the county
 of Cattaraugus pursuant to section one of this act shall be described as
 "Perrysburg Pond", "Crocker's Pond", and "Bob's Pond", designated as Tax
 Map No. 2.003-1-20.
   § 4. The land to be transferred pursuant to this act, and  all  struc-
 tures  and  facilities situated on such land, shall be maintained, owned
 and operated for recreational purposes by the state of New York. The use
 of such parkland and facilities shall continue to be made  available  to
 the general public, including all residents of Cattaraugus County. Where
 the  availability of such facilities is limited, the use of such facili-
 ties must be determined by an equitable method which  provides  priority
 use  to the general public based on a reservation policy for free or for
 a nominal charge.
   § 5. This act shall take effect immediately.
