TITLE OF BILL:

An act to amend the judiciary law, in relation to requiring an individ-
ual convicted on an impeachment from reimbursing the state for all costs
associated with the impeachment investigation and costs related to the
individual's defense

 
PURPOSE:

This bill would require an individual that is convicted on an impeach-
ment from reimbursing taxpayers for costs associated with the impeach-
ment investigation and the convicted individual's defense.

 
SUMMARY OF PROVISIONS:

Section one of this bill requires an individual convicted on an impeach-
ment to reimburse the state for any costs incurred by the state associ-
ated with the impeachment investigation and costs related to the indi-

vidual's defense, including attorney's fees. The bill also prohibits the
state from reimbursing such individual for any costs incurred by the
individual for representation or defense related to the impeachment
investigation or proceedings.

Section two establishes the effective date.

 
JUSTIFICATION:

The nursing home and sexual harassment investigations of Governor Cuomo
are costing state taxpayers over $10 million. The $10 million is affil-
iated with seven legal contracts.

News reports have stated Governor Cuomo will spend more than $2.5
million on legal defense as his administration is investigated by feder-
al authorities for allegedly covering up the number of deaths within
nursing homes during the COVID-19 pandemic.

The Governor, whose actions have led to these investigations, should be
held liable to pick up the costs of the investigations and his on
defense. if it is found he committed wrongdoing and is convicted on an
impeachment.

Taxpayer money should not be used to defend wrongdoing and possible
criminal acts by an elected official.

 AN ACT to amend the judiciary law, in relation to requiring an  individ-
   ual  convicted  on  an  impeachment from reimbursing the state for all
   costs associated with the impeachment investigation and costs  related
   to the individual's defense
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The judiciary law is amended by adding a new section  248-a
 to read as follows:
   §  248-A.  REIMBURSEMENT  OF INVESTIGATION AND DEFENSE COSTS. NOTWITH-
 STANDING ANY OTHER PROVISION OF LAW, UPON CONVICTION ON AN  IMPEACHMENT,
 SUCH  CONVICTED  INDIVIDUAL  SHALL  REIMBURSE  THE  STATE  FOR ANY COSTS
 INCURRED BY THE STATE ASSOCIATED WITH THE IMPEACHMENT INVESTIGATION  AND
 COSTS  RELATED TO THE INDIVIDUAL'S DEFENSE, INCLUDING BUT NOT LIMITED TO
 ATTORNEY'S FEES. THE STATE SHALL NOT REIMBURSE SUCH INDIVIDUAL  FOR  ANY
 COSTS  INCURRED  BY THE INDIVIDUAL FOR REPRESENTATION OR DEFENSE OF SUCH
 INDIVIDUAL IN RELATION TO THE IMPEACHMENT INVESTIGATION OR  PROCEEDINGS,
 INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES.
   § 2. This act shall take effect immediately.
