BILL NUMBER: S7333 SPONSOR: MARTUCCI TITLE OF BILL: An act to amend the public officers law, in relation to conducting meet- ings of public bodies via video conference technology or via simultane- ous video conference and in-person PURPOSE: This legislation would facilitate the conducting of remote meetings to make it more convenient for public bodies to conduct business and the public to observe and participate in meetings and hearings of public bodies. SUMMARY OF PROVISIONS: Section 1. Amends paragraph (c)of § 103 of the public officers law to allow public bodies to more easily conduct remote meetings.

MARTUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public officers law, in relation to conducting meet- ings of public bodies via video conference technology or via simul- taneous video conference and in-person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of section 103 of the public officers law, as added by chapter 289 of the laws of 2000, is amended to read as follows: (c) (I) A public body that uses videoconferencing to conduct its meet- ings shall provide an opportunity for the public to attend, listen and observe at any site at which a member participates. (II) IN THE ALTERNATIVE, A PUBLIC BODY OF A MUNICIPAL CORPORATION AS DEFINED IN SECTION SIXTY-SIX OF THE GENERAL CONSTRUCTION LAW MAY CONDUCT A MEETING VIA VIDEO CONFERENCE OR VIA SIMULTANEOUS VIDEO CONFERENCE AND IN-PERSON IF THE PUBLIC BODY: (1) PROVIDES AN OPPORTUNITY FOR THE PUBLIC TO CONTEMPORANEOUSLY VIEW AND LISTEN TO SUCH MEETING ONLINE; (2) MAKES A VIDEO RECORDING OF THE MEETING; AND (3) POSTS THE RECORDING ON THE PUBLIC BODY'S WEBSITE WITHIN FIVE BUSINESS DAYS OF THE MEETING. IN ADDITION, UPON REQUEST OF A MEMBER OF THE PUBLIC, THE PUBLIC BODY MUST MAKE AVAILABLE A SPECIFIC LOCATION WITHIN THE JURISDICTION OF THE MUNIC- IPAL CORPORATION FOR THE PUBLIC TO VIEW AND LISTEN TO SUCH MEETING ONLINE, PROVIDED THE REQUEST IS RECEIVED AT LEAST FORTY-EIGHT HOURS PRIOR TO THE TIME THE MEETING IS SCHEDULED TO BEGIN. § 2.
