BILL NUMBER: S7379 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the penal law, in relation to including corrections officers in certain assault charges PURPOSE: The purpose of this bill is to make it a class C felony to assault a corrections officer while such officer is performing their professional duties. SUMMARY OF PROVISIONS: Section 1. Amends section 120.08 of the penal law to add corrections officers to the section of law that creates a class C felony for assault on a peace officer, police officer, firefighter or emergency medical services professional.

STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the penal law, in relation to including corrections officers in certain assault charges THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 120.08 of the penal law, as amended by chapter 476 of the laws of 2018, is amended to read as follows: § 120.08 Assault on a peace officer, police officer, CORRECTIONS OFFI- CER, firefighter or emergency medical services professional. A person is guilty of assault on a peace officer, police officer, CORRECTIONS OFFICER, firefighter or emergency medical services profes- sional when, with intent to prevent a peace officer, police officer, CORRECTIONS OFFICER, a firefighter, including a firefighter acting as a paramedic or emergency medical technician administering first aid in the course of performance of duty as such firefighter, or an emergency medical service paramedic or emergency medical service technician, from performing a lawful duty, he or she causes serious physical injury to such peace officer, police officer, CORRECTIONS OFFICER, firefighter, paramedic or technician. Assault on a peace officer, police officer, CORRECTIONS OFFICER, fire- fighter or emergency medical services professional is a class C felony. § 2. This act shall take effect immediately.
