BILL NUMBER: S7414 SPONSOR: STEC TITLE OF BILL: An act relating to granting a waiver to Adirondack Helping Hands for the 2016--2017 school year PURPOSE: The bill ratifies a waiver for $52,000 in spending by Adirondack Helping Hands Inc. in the 201617 school year relating to its 9160 program, and prohibits the state from imposing penalties in subsequent years. SUMMARY OF PROVISIONS: Section 1 - Grants a waiver for $52,000 relating to a special class in an integrated setting. The spending shall be offset by $52,000 in recog- nized surplus at the school, and another $16,000 shall be recouped through reconciliation. STEC -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT relating to granting a waiver to Adirondack Helping Hands for the 2016--2017 school year THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. (a) Notwithstanding any provision of law, rule, or regu- lation to the contrary, Adirondack Helping Hands shall be granted a waiver in the amount of $52,000 for services rendered during the 2016--2017 school year. Such waiver shall be allocated to costs associ- ated with special class in an integrated setting spending for the 2016- -2017 school year. Adirondack Helping Hands shall reduce any recognized surplus for such school year by $52,000. A final surplus of $16,000 shall be recoverable on reconciliation. (b) For purposes of this section, "special class in an integrated setting" shall mean a classroom where students with intellectual and developmental disabilities receive special services and supports while learning alongside students without such disabilities. § 2. The commissioner of education is hereby directed to calculate and finalize any rate reconciliation for Adirondack Helping Hands and shall submit such rate reconciliation to the director of the budget, who is hereby directed to approve such submittal. § 3. No additional penalty associated with such waiver shall be levied against Adirondack Helping Hands in any subsequent school year. § 4. This act shall take effect immediately.
