BILL NUMBER: S7443 SPONSOR: SALAZAR TITLE OF BILL: An act to amend the public health law, in relation to funding for providers who engage in treatment and services for people with HIV/AIDS SUMMARY OF PROVISIONS: Section 1 amends paragraph (e) of subdivision 1 of section 2776 of the public health law to provide that funding administered by the AIDS Institute shall not include requirements inconsistent with federal guid- ance for the administration of the Ryan White HIV/AIDS Program, and further that the Institute shall not require that funds only be avail- able to clinics or hospital licensed pursuant to public health law arti- cle 28. SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public health law, in relation to funding for providers who engage in treatment and services for people with HIV/AIDS THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (e) of subdivision 1 of section 2776 of the public health law, as added by chapter 823 of the laws of 1983, is amended to read as follows: (e) to promote the availability of supportive services for affected persons; PROVIDED, HOWEVER, THAT REQUEST FOR APPLICATIONS FOR FUNDING ADMINISTERED BY THE INSTITUTE SHALL NOT INCLUDE MINIMUM REQUIREMENTS INCONSISTENT WITH THE FEDERAL HEALTH RESOURCE AND SERVICES ADMINIS- TRATION GUIDANCE FOR THE ADMINISTRATION OF THE RYAN WHITE HIV/AIDS PROGRAM. FURTHERMORE, THE INSTITUTE SHALL NOT REQUIRE FUNDS BE ADMINIS- TERED TO CLINICS OR HOSPITALS LICENSED PURSUANT TO ARTICLE TWENTY-EIGHT OF THIS CHAPTER. § 2. This act shall take effect immediately.
