BILL NUMBER: S7515 SPONSOR: MAY TITLE OF BILL: An act to amend the general business law, in relation to requiring certain people to report suspected financial exploitation of an elderly, vulnerable elderly person, incompetent or physically disabled person, or incapacitated person PURPOSE: To increase detection of attempted financial exploitation, thereby reducing the loss of assets of elderly and vulnerable individuals SUMMARY OF PROVISIONS: Section 1: adds a new section 349-g to the general business law to require financial institutions, certified public accountants, licensed attorneys or preparers of taxes to report any suspicion of financial exploitation of an elderly person, vulnerable elderly person, incompe- tent or physically disabled person, or incapacitated person.

MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to requiring certain people to report suspected financial exploitation of an elder- ly, vulnerable elderly person, incompetent or physically disabled person, or incapacitated person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 349-g to read as follows: § 349-G. REPORTING OF SUSPECTED FINANCIAL EXPLOITATION. 1. AS USED IN THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "FINANCIAL INSTITUTION" SHALL MEAN ANY OF THE FOLLOWING: (I) A DEPOSITORY INSTITUTION, AS DEFINED IN SECTION 3(C) OF THE FEDER- AL DEPOSIT INSURANCE ACT (12 U.S.C. SEC. 1813(C)) AND A BANK DEFINED IN SECTION TWO OF THE BANKING LAW; (II) AN INSTITUTION-AFFILIATED PARTY, AS DEFINED IN SECTION 3(U) OF THE FEDERAL DEPOSIT INSURANCE ACT (12 U.S.C. SEC. 1813(U)); (III) A FEDERAL CREDIT UNION OR STATE CREDIT UNION, AS DEFINED IN SECTION 101 OF THE FEDERAL CREDIT UNION ACT (12 U.S.C. SEC. 1752), INCLUDING, BUT NOT LIMITED TO, AN INSTITUTION-AFFILIATED PARTY OF A CREDIT UNION, AS DEFINED IN SECTION 206(R) OF THE FEDERAL CREDIT UNION ACT (12 U.S.C. SEC. 1786(R)). (B) "ELDERLY PERSON" SHALL MEAN A PERSON SEVENTY-FIVE YEARS OF AGE OR OLDER. (C) "INCAPACITATED PERSON" SHALL MEAN A PERSON ADJUDICATED AS INCAPAC- ITATED UNDER THE MENTAL HYGIENE LAW OR DEEMED TO BE MENTALLY OR PHYS- ICALLY INCAPACITATED BY A PHYSICIAN. (D) "VULNERABLE ELDERLY PERSON" SHALL MEAN A PERSON SIXTY YEARS OF AGE OR OLDER WHO IS SUFFERING FROM A DISEASE OR INFIRMITY ASSOCIATED WITH ADVANCED AGE AND MANIFESTED BY DEMONSTRABLE PHYSICAL, MENTAL OR EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
