Relates to sanitation services provided to the New York city housing authority; provides notwithstanding the provisions of section 16-114 of the administrative code of the city of New York, the New York city housing authority shall not be required to pay for sanitation services provided by the sanitation department of the city of New York.

BILL NUMBER: S7608 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the public housing law, in relation to sanitation services provided to the New York city housing authority PURPOSE: To prevent the New York City Housing Authority from using scarce housing funds to pay for sanitation services provided by the New York City Department of Sanitation. SUMMARY OF PROVISIONS: Section 1 amends Section 402 of the public housing law by adding a new subdivision 5-b nullifying any arrangement by which the New York City Housing Authority agrees to or is required to pay for sanitation services provided by the City of New York. Section 2 sets forth the effective date.

KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public housing law, in relation to sanitation services provided to the New York city housing authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 402 of the public housing law is amended by adding a new subdivision 5-b to read as follows: 5-B. NOTWITHSTANDING THE PROVISIONS OF SECTION 16-114 OF THE ADMINIS- TRATIVE CODE OF THE CITY OF NEW YORK, THE NEW YORK CITY HOUSING AUTHORI- TY SHALL NOT BE REQUIRED TO PAY FOR SANITATION SERVICES PROVIDED BY THE SANITATION DEPARTMENT OF THE CITY OF NEW YORK PURSUANT TO TITLE SIXTEEN OF SUCH CODE. ANY PROVISION OF ANY AGREEMENT, CONTRACT, MEMORANDUM OF UNDERSTANDING, OR OTHER ARRANGEMENT BY WHICH THE NEW YORK CITY HOUSING AUTHORITY AGREES OR IS REQUIRED TO PAY FOR SUCH SANITATION SERVICES SHALL BE NULL AND VOID; PROVIDED THAT THIS SUBDIVISION SHALL NOT AFFECT OR IMPAIR THE EFFECTIVENESS OR ENFORCEABILITY OF ANY OTHER PROVISION OF SUCH AGREEMENT, CONTRACT, MEMORANDUM OF UNDERSTANDING, OR OTHER ARRANGE- MENT. § 2.
