BILL NUMBER: S7646 SPONSOR: KAPLAN TITLE OF BILL: An act to amend the penal law, in relation to establishing the crime of doxing of an individual PURPOSE: This legislation creates the crime of doxxing an individual and makes it a Class A misdemeanor. SUMMARY OF PROVISIONS: Section 1 creates a new section 240.33 of the penal law to create the crime of doxxing. A person is guilty of the crime of doxxing when they knowingly make restricted personal information about an individual publicly available with the intent to threaten, intimidate, or incite the commission of a crime of violence against the individual or have intent and knowledge that the restricted personal information will be used to to threaten, intimidate, or facilitate the commission of a crime

KAPLAN -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the crime of doxing of an individual THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 240.33 to read as follows: § 240.33 DOXING OF AN INDIVIDUAL. A PERSON IS GUILTY OF DOXING OF AN INDIVIDUAL WHEN HE OR SHE KNOWINGLY MAKES RESTRICTED PERSONAL INFORMATION ABOUT AN INDIVIDUAL PUBLICLY AVAILABLE: 1. WITH THE INTENT TO THREATEN, INTIMIDATE, OR INCITE THE COMMISSION OF A CRIME OF VIOLENCE AGAINST THE INDIVIDUAL; OR 2. WITH THE INTENT AND KNOWLEDGE THAT THE RESTRICTED PERSONAL INFORMA- TION WILL BE USED TO THREATEN, INTIMIDATE, OR FACILITATE THE COMMISSION OF A CRIME OF VIOLENCE AGAINST THE INDIVIDUAL. 3. FOR THE PURPOSES OF THIS SECTION, "RESTRICTED PERSONAL INFORMATION" SHALL MEAN IDENTIFYING INFORMATION REGARDING AN INDIVIDUAL, INCLUDING BUT NOT LIMITED TO NAMES, TELEPHONE NUMBERS, EMAIL ADDRESSES, AND PHYS- ICAL OR MAILING ADDRESSES, WHICH THE INDIVIDUAL HAS NOT MADE READILY APPARENT TO THE PUBLIC, OR WHICH THE INDIVIDUAL HAS NOT AUTHORIZED ANOTHER PERSON OR ORGANIZATION TO MAKE READILY APPARENT TO THE PUBLIC. DOXING OF AN INDIVIDUAL IS A CLASS A MISDEMEANOR. § 2. This act shall take effect on the thirtieth day after it shall have become a law.
