 Introduced  by  Sen. SKOUFIS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Housing, Construction  and
   Community Development
 
 AN  ACT to amend the executive law, in relation to exempting hot tubs or
   spas with safety covers from certain provisions of law
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Paragraph c of subdivision 14 of section 378 of the execu-
 tive law, as added by chapter 75 of the laws of 2007, is amended to read
 as follows:
   c. hot tub or spa with a safety cover  which  complies  with  American
 Society  of Testing and Materials International standard F1346 (2003) or
 any similar standard which may be approved by the  council  or  swimming
 pool,  other than a hot tub or spa, with an automatic power safety cover
 which complies with American Society of Testing and  Materials  Interna-
 tional  standard  F1346  (2003)  or  any  similar  standard which may be
 approved by the council shall be exempt from the  provisions  of  [para-
 graph b of] this subdivision.
   § 2. This act shall take effect immediately.
