BILL NUMBER: S796 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the labor law, in relation to extending the statute of limitations relating to a civil action by an employee who has been the subject of a retaliatory personnel action PURPOSE OF BILL: This bill would extend the statute of limitations from one year to two years relating to a civil action by an employee who has been the subject of a retaliatory personnel action. SUMMARY OF PROVISIONS: Section 1 of the bill amends section 740(4)(a) of the Labor Law to extend the statute of limitations from one year to two years relating to a civil action by an employee who has been the subject of a retaliatory personnel action.

HOYLMAN, LIU -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to extending the statute of limitations relating to a civil action by an employee who has been the subject of a retaliatory personnel action THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 4 of section 740 of the labor law, as added by chapter 660 of the laws of 1984, is amended to read as follows: (a) An employee who has been the subject of a retaliatory personnel action in violation of this section may institute a civil action in a court of competent jurisdiction for relief as set forth in subdivision five of this section within [one year] TWO YEARS after the alleged retaliatory personnel action was taken. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02574-01-1
