BILL NUMBER: S8078 SPONSOR: CLEARE TITLE OF BILL: An act in relation to enacting the "protect main street act"; and providing for the repeal of such provisions upon the expiration thereof PURPOSE OF BILL: The purpose of the Main Street is to provide a settlement conference so that the commercial tenant and the landlord are provided an opportunity to explore settlement options and avoid the necessity of litigation. Such conferences are necessary to encourage good faith negotiation to protect the leasehold interest of the tenant and to maintain the charac- ter of our neighborhoods and avoid empty storefronts. SUMMARY OF SPECIFIC PROVISIONS: Section (1) provides this act shall be known as may be cited as the "Protect Main Street Act."

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT in relation to enacting the "protect main street act"; and providing for the repeal of such provisions upon the expiration there- of THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "protect main street act". § 2. Notwithstanding any provision of law to the contrary, prior to any further proceedings in a commercial eviction matter commenced on or after March 17, 2020, the court shall hold a settlement conference to address subjects related to COVID-19 pandemic concerns and relevant legal defenses, including but not limited to, whether an unanticipated event that could not have been foreseen or guarded against in the lease contract made performance of the subject matter of the contract, in full or in part, objectively impossible. § 3. This act shall take effect immediately and shall expire and be deemed repealed one year after such date.
