BILL NUMBER: S8207 SPONSOR: CLEARE TITLE OF BILL: An act to amend the executive law, in relation to increasing the penal- ties for certain unlawful discriminatory practices based on the lawful source of income of the victim PURPOSE OR GENERAL IDEA OF BILL: To double the financial penalties for violation of the existing lawful source of income statute, where the respondent receives federal state or local support on the underlying accommodation. SUMMARY OF SPECIFIC PROVISIONS: This bill doubles the financial penalties for violation of the existing lawful source of income statute, where the respondent receives federal state or local support on the underlying accommodation.

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the executive law, in relation to increasing the penal- ties for certain unlawful discriminatory practices based on the lawful source of income of the victim THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 297 of the executive law is amended by adding a new paragraph f to read as follows: F. ANY MONETARY DAMAGES OR FINES AWARDED OR ASSESSED PURSUANT TO PARA- GRAPH C OF THIS SUBDIVISION SHALL BE DOUBLED WHERE A RESPONDENT IS FOUND TO HAVE ENGAGED IN AN UNLAWFUL DISCRIMINATORY PRACTICE DEFINED IN SUBDI- VISIONS TWO-A OR FIVE OF SECTION TWO HUNDRED NINETY-SIX OF THIS ARTICLE WHICH IS BASED ON THE LAWFUL SOURCE OF INCOME OF THE VICTIM OF SUCH UNLAWFUL DISCRIMINATORY PRACTICE, AND SUCH RESPONDENT RECEIVES FEDERAL, STATE OR LOCAL TAX BENEFITS FOR THE HOUSING ACCOMMODATION AT ISSUE IN THE COMPLAINT. § 2.
