BILL NUMBER: S8260 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the public health law, in relation to creating a live kidney donor follow-up study; and providing for the repeal of such provisions upon expiration thereof PURPOSE: To create a donor follow-up study for New York living kidney donors and incentivize donor participation through a yearly stipend. Also estab- lishes health related expenses coverage for all living kidney donors for five years post-donation. SUMMARY OF PROVISIONS: Section 1: Amends the public health law by adding a new section 4311, which establishes the parameters of the New York living kidney donor follow-up study and directs the Department of Health to contract with a qualified research team to conduct the study.

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to creating a live kidney donor follow-up study; and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 4311 to read as follows: § 4311. NEW YORK LIVING KIDNEY DONOR FOLLOW-UP STUDY. 1. THE DEPART- MENT SHALL CONTRACT WITH A QUALIFIED RESEARCH TEAM TO CONDUCT A PROSPEC- TIVE STUDY OF LIVING KIDNEY DONOR HEALTH. SUCH STUDY SHALL FOLLOW PEOPLE WHO DONATE A KIDNEY IN NEW YORK BETWEEN JANUARY FIRST, TWO THOUSAND TWENTY-THREE AND DECEMBER THIRTY-FIRST, TWO THOUSAND TWENTY-SEVEN FOR TEN YEARS WHOSE TRANSPLANT SURGERY TAKES PLACE. ALL DONORS WHO AGREE TO PROVIDE THEIR FOLLOW-UP DATA FOR USE IN SUCH STUDY WILL RECEIVE A STIPEND OF ONE THOUSAND DOLLARS FOR EACH YEAR OF FOLLOW-UP THEY FULLY PARTICIPATE IN. THE COMMISSIONER SHALL SUBMIT A REPORT INCLUDING RECOM- MENDATIONS AND FINDINGS BASED ON THIS STUDY TO THE GOVERNOR, THE TEMPO- RARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEMBLY AND THE CHAIRS OF THE SENATE AND ASSEMBLY STANDING COMMITTEES ON HEALTH NO LATER THAN DECEMBER THIRTY-FIRST, TWO THOUSAND TWENTY-THREE AND EACH DECEMBER THIR- TY-FIRST THEREAFTER. 2. FOR THE FIRST FIVE YEARS POST DONATION, KIDNEY DONORS SHALL EACH BE ENTITLED TO UP TO TWO THOUSAND DOLLARS TO PAY COPAYMENTS AND OTHER HEALTH-RELATED EXPENSES. § 2. This act shall take effect immediately and shall expire and be deemed repealed January 1, 2038. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
