TITLE OF BILL:

An act to amend the economic development law, in relation to the
creation of an online, searchable database to catalogue workforce devel-
opment programs in the state

 
PURPOSE OR GENERAL IDEA OF BILL:

Provides for the creation of an online, searchable database to catalogue
workforce development programs in the state

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1.  Subdivision 49 of section 100 of the economic development
law, as renumbered by chapter 781 of the laws of 2021 is renumbered
subdivision 50 and a new subdivision 49 is added.

Section 49 provides that in conjunction with the department of labor,
establish and maintain an online searchable database to catalogue and

make available information on workforce development funding programs and
may publish any analysis or reports conducted or authorized by the
department, or other state agencies or entities, on any such data,
reports or information.

Section 2. Effective date.

 
JUSTIFICATION:

New York State spends billions of dollars each year on workforce prepa-
ration and adult education, and many of the providers of these services
rely on state and federal funds. However, the funding is broken up into
more than 50 different programs, each with differing amounts, criteria
for eligibility and spending, and disbursement rules. Having a complete
listing with relevant information would be extremely useful to providers
and the public which must piece together the various funding programs.
The annual update is necessary because many of the programs' rules and
amounts change from year to year.

 AN  ACT  to  amend  the  economic  development  law,  in relation to the
   creation of an online,  searchable  database  to  catalogue  workforce
   development programs in the state

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 49 of section 100 of the  economic  development
 law,  as  renumbered  by  chapter 781 of the laws of 2021, is renumbered
 subdivision 50 and a new subdivision 49 is added to read as follows:
   49. (A) TO, IN CONJUNCTION WITH THE DEPARTMENT OF LABOR, ESTABLISH AND
 MAINTAIN AN ONLINE, SEARCHABLE DATABASE TO CATALOGUE AND  MAKE AVAILABLE
 INFORMATION ON WORKFORCE DEVELOPMENT FUNDING PROGRAMS  AND  MAY  PUBLISH
 ANY  ANALYSIS  OR  REPORTS CONDUCTED OR AUTHORIZED BY THE DEPARTMENT, OR
 OTHER STATE AGENCIES OR ENTITIES, ON ANY SUCH DATA, REPORTS OR  INFORMA-
 TION.  SUCH  AN ONLINE, SEARCHABLE WORKFORCE DEVELOPMENT DATABASE  SHALL
 BE MADE AVAILABLE BY THE DEPARTMENT BY JANUARY FIRST, TWO THOUSAND TWEN-
 TY-THREE AND UPDATED  AT  LEAST  QUARTERLY,  THEREAFTER.  THE  WORKFORCE
 DEVELOPMENT  ONLINE,  SEARCHABLE DATABASE SHALL PROVIDE PROGRAM INFORMA-
 TION RELATED TO FEDERAL AND STATE  FUNDING  AND  PROGRAMS  THAT  PROVIDE
 TARGETED  EDUCATIONAL, OCCUPATIONAL OR TRAINING SERVICES FOR THE PURPOSE
 OF EFFECTING THE EMPLOYABILITY OF THE PARTICIPANT, PROVIDES TRAINING  OR
 EMPLOYMENT  SERVICES,  SUPPORTS  AN  ECONOMIC  DEVELOPMENT  ACTIVITY  BY
 ENHANCING THE SKILLS OF THE STATE'S WORKFORCE, PREPARES INDIVIDUALS  FOR
 EMPLOYMENT,  IMPROVES  OPPORTUNITIES FOR INDIVIDUALS TO BECOME EMPLOYED,
 OR PROMOTES UNDERSTANDING  OF  THE  STATE  LABOR  FORCE  MARKET  THROUGH
 STATISTICAL  STUDIES, INCLUDING BUT NOT LIMITED TO PROGRAMS THAT FUND OR
 PROVIDE ENGLISH AS A SECOND LANGUAGE AND ADULT LITERACY. FOR EACH  WORK-
 FORCE DEVELOPMENT FUNDING PROGRAM, THE ONLINE, SEARCHABLE DATABASE SHALL
 INCLUDE, BUT NOT BE LIMITED TO, THE FOLLOWING INFORMATION FOR EACH FUND-
 ING PROGRAM:
   (I) THE NAME OF THE FUNDING PROGRAM AND THE FEDERAL OR STATE AGENCY OR
 ENTITY ADMINISTERING THE FUNDING PROGRAM;
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   (II) A DESCRIPTION OF THE PURPOSE OF THE FUNDING PROGRAM;
   (III) A SPECIFIC PROGRAM UNIFORM RESOURCE LOCATOR ("URL"), IF ANY;
   (IV) THE YEAR THE PROGRAM WAS ESTABLISHED;
   (V) A CATALOG OF FEDERAL DOMESTIC ASSISTANCE NUMBERS, IF ANY;
   (VI) THE LEGAL AUTHORITY, INCLUDING STATUTE AND REGULATION CITATIONS;
   (VII)  THE  PROGRAM  AND  FISCAL  CONTACT INFORMATION INCLUDING AGENCY
 NAME, TELEPHONE NUMBER, AND EMAIL ADDRESS;
   (VIII) ALL ELIGIBILITY REQUIREMENTS;
   (IX) ANY PROGRAM AND SPECIAL RESTRICTIONS;
   (X) ANY ACTION OR ACTIONS REQUIRED TO RECEIVE AID;
   (XI) A DESCRIPTION OF AID WHICH SHALL INCLUDE, BUT NOT BE LIMITED  TO,
 THE  FLOW  OF  FUNDS BETWEEN ENTITIES, THE TYPE OF AID FORMULA USED, ANY
 MATCHING REQUIREMENTS AND ANY MAINTENANCE OF EFFORT;
   (XII) ALL AMOUNTS APPROPRIATED IN THE MOST RECENT THREE YEARS,  BROKEN
 DOWN  BY  FISCAL  YEAR  AND  CATEGORIZED BY FEDERAL FUNDS, STATE GENERAL
 FUNDS AND STATE SPECIAL REVENUE;
   (XIII) ALL AMOUNTS DISBURSED FOR THE PRIOR  TWO  FISCAL  YEARS  BROKEN
 DOWN  BY  FEDERAL  FUNDS, STATE GENERAL FUNDS AND STATE SPECIAL REVENUE;
 AND
   (XIV) ALL RELEVANT DATA ON THE  OUTCOMES  AND  EFFECTIVENESS  OF  SUCH
 FUNDING PROGRAM AND THE NUMBER OF PERSONS SERVED BY SUCH FUNDING.
   (B)  ANY STATE AGENCY OR ENTITY THAT ADMINISTERS OR OVERSEES WORKFORCE
 DEVELOPMENT FUNDING, WORKFORCE DEVELOPMENT PROGRAMS, OR OTHER  DATABASES
 OR  CATALOGUES  SHALL: (I) PROVIDE A LINK ON THEIR WEBSITES TO THE WORK-
 FORCE DEVELOPMENT DATABASE MAINTAINED BY THE DEPARTMENT; AND (II) REPORT
 TO THE COMMISSIONER, WITHIN FORTY-FIVE DAYS OF THE END OF THE APPLICABLE
 FISCAL YEAR FOR THE FUNDING PROGRAM, THE INFORMATION SPECIFIED IN  PARA-
 GRAPH  (A)  OF THIS SUBDIVISION, TOGETHER WITH SUCH OTHER INFORMATION AS
 THE COMMISSIONER DEEMS MATERIAL  AND  NECESSARY  FOR  INCLUSION  IN  THE
 ONLINE,  SEARCHABLE  DATABASE.  THE STATE AGENCY OR ENTITY SHALL PROVIDE
 INFORMATION THROUGH AN ELECTRONIC  REPORTING  SYSTEM  AVAILABLE  ON  THE
 DEPARTMENT'S WEBSITE.
   § 2. This act shall take effect immediately.
