BILL NUMBER: S9329 SPONSOR: JACKSON TITLE OF BILL: An act to amend the retirement and social security law, in relation to waiving the earning limitations for retired sworn officers employed by a district attorney as investigators PURPOSE: The purpose of this bill is to allow retired former sworn police detec- tives and investigators to become employed by a District Attorney as sworn police detective and investigator within a district attorney's office without requiring a 211 waiver. SUMMARY OF PROVISIONS: Section 1 adds a new subdivision 4 to Section 212 of the Retirement and Social Security Law that waives the earnings limitation for retired sworn officers employed by a district attorney as investigators.

JACKSON -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the retirement and social security law, in relation to waiving the earning limitations for retired sworn officers employed by a district attorney as investigators THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 212 of the retirement and social security law is amended by adding a new subdivision 4 to read as follows: 4. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISIONS ONE AND TWO OF THIS SECTION, EARNINGS LIMITATIONS SHALL NOT APPLY TO SWORN INVESTIGATORS EMPLOYED BY A DISTRICT ATTORNEY OF ANY COUNTY WITHIN THE STATE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15397-01-2
