 Introduced  by  Sen. REICHLIN-MELNICK -- read twice and ordered printed,
   and when printed to be committed to the Committee on Codes
 
 AN ACT to amend the penal law, in relation  to  criminal  possession  of
   semiautomatic rifles, shotguns and pistols by persons under the age of
   twenty-one
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 265.01 of the penal law is amended by adding a  new
 subdivision 11 to read as follows:
   (11)  HE OR SHE POSSESSES A SEMIAUTOMATIC RIFLE, A SEMIAUTOMATIC SHOT-
 GUN OR A SEMIAUTOMATIC  PISTOL  DEFINED  IN  SUBDIVISION  TWENTY-ONE  OF
 SECTION  265.00 OF THIS ARTICLE AND IS UNDER THE AGE OF TWENTY-ONE YEARS
 OLD, EXCEPT IF HE OR SHE WAS OVER THE AGE OF EIGHTEEN PRIOR  TO  JANUARY
 FIRST, TWO THOUSAND TWENTY-THREE.
   § 2. Section 265.10 of the penal law is amended by adding a new subdi-
 vision 9 to read as follows:
   9.  ANY  PERSON WHO DISPOSES OF ANY SEMIAUTOMATIC RIFLE, SEMIAUTOMATIC
 SHOTGUN OR SEMIAUTOMATIC PISTOL DEFINED  IN  SUBDIVISION  TWENTY-ONE  OF
 SECTION  265.00  OF  THIS  ARTICLE  TO ANY OTHER PERSON UNDER THE AGE OF
 TWENTY-ONE YEARS IS GUILTY OF A CLASS A MISDEMEANOR  UNLESS  SUCH  OTHER
 PERSON WAS OVER THE AGE OF EIGHTEEN PRIOR TO JANUARY FIRST, TWO THOUSAND
 TWENTY-THREE.
   § 3. This act shall take effect immediately.
