BILL NUMBER: S9577 SPONSOR: BAILEY TITLE OF BILL: An act to amend the state finance law, in relation to establishing the New York state youth sports initiative grants fund PURPOSE: The purpose of this legislation is to establish a fund to promote youth sports across our state. SUMMARY OF SPECIFIC PROVISIONS: The first section of the bill establishes the "youth sports initiative grants fund" under the direction of the state comptroller and the commissioner of education. The funds are to be allocated to an eligible not-for-profit youth sports organization operating in the state as chosen by the commissioner. The commissioner shall promulgate the rules necessary for operating the fund, and will be required to timely submit a report to the governor, the temporary president of the senate, and the

BAILEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the state finance law, in relation to establishing the New York state youth sports initiative grants fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state finance law is amended by adding a new section 99-qq to read as follows: § 99-QQ. NEW YORK STATE YOUTH SPORTS INITIATIVE GRANTS FUND. 1. A SPECIAL FUND TO BE KNOWN AS THE "NEW YORK STATE YOUTH SPORTS INITIATIVE GRANTS FUND" IS HEREBY ESTABLISHED IN THE CUSTODY OF THE STATE COMP- TROLLER AND THE COMMISSIONER OF EDUCATION. 2. THE FUND SHALL CONSIST OF ALL MONIES APPROPRIATED FOR ITS PURPOSE, ALL MONIES TRANSFERRED TO SUCH FUND PURSUANT TO LAW, ALL MONIES REQUIRED BY THIS SECTION OR ANY OTHER PROVISION OF LAW TO BE PAID INTO OR CREDIT- ED TO THE FUND AND ANY INTEREST EARNINGS WHICH MAY ACCRUE FROM THE INVESTMENT OF MONIES IN THE FUND. NOTHING CONTAINED HEREIN SHALL PREVENT THE COMPTROLLER OR COMMISSIONER OF EDUCATION FROM RECEIVING GRANTS, GIFTS OR BEQUESTS FOR THE PURPOSES OF THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM INTO THE FUND ACCORDING TO LAW. 3. MONIES OF THE FUND, WHEN ALLOCATED, SHALL BE AVAILABLE TO MAKE GRANTS TO ELIGIBLE NOT-FOR-PROFIT YOUTH SPORTS ORGANIZATIONS. NOT-FOR- PROFIT YOUTH SPORTS ORGANIZATIONS SHALL BE CHOSEN BY THE COMMISSIONER OF EDUCATION FOR SUCH GRANTS BASED ON CRITERIA ESTABLISHED BY THE COMMIS- SIONER OF EDUCATION FOR SUCH PURPOSE. 4. MONIES SHALL BE PAYABLE FROM THE FUND ON THE AUDIT AND WARRANT OF THE COMPTROLLER ON VOUCHERS APPROVED AND CERTIFIED BY THE COMMISSIONER OF EDUCATION. 5. THE COMMISSIONER OF EDUCATION SHALL PROMULGATE ANY RULES AND REGU- LATIONS NECESSARY TO CARRY OUT THE PROVISIONS OF THIS SECTION. 6. ADDITIONALLY, THE COMMISSIONER OF EDUCATION SHALL SUBMIT A REPORT TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY, PRIOR TO, BUT IN NO EVENT LATER THAN, DECEMBER THIRTY- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
