DILAN -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to prohibiting certain pre-K programs from requiring the influenza vaccine for chil- dren entering such programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2164 of the public health law is amended by adding a new subdivision 9 to read as follows: 9. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, NO PERSON IN PARENTAL RELATION TO A CHILD IN THIS STATE ENTERING OR HAVING ENTERED A CHILD CARE, HEAD START, NURSERY, 3-K OR PRE-K PROGRAM OR A COMPARABLE PROGRAM FOR CHILDREN AGE SIX MONTHS THROUGH FIFTY-NINE MONTHS, SHALL BE REQUIRED TO HAVE ADMINISTERED TO SUCH CHILD AN IMMUNIZATION AGAINST INFLUENZA. § 2.
