ENGLEBRIGHT -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation, in relation to the investment of funds to combat climate change THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 75-0117 of the environmental conservation law, as added by chapter 106 of the laws of 2019, is amended to read as follows: § 75-0117. Investment of funds. State agencies, authorities and entities, in consultation with the environmental justice working group and the climate action council, shall, to the extent practicable, invest or direct available and rele- vant programmatic resources [in a manner designed] to [achieve a goal for disadvantaged communities to receive] PROVIDE forty percent of over- all benefits of spending on clean energy and energy efficiency programs, projects or investments in the areas of housing, workforce development, pollution reduction, low income energy assistance, energy, transporta- tion and economic development[, provided however, that disadvantaged communities shall receive no less than thirty-five percent of the over- all benefits of spending on clean energy and energy efficiency programs, projects or investments and provided further that this section shall not alter funds already contracted or committed as of the effective date of this section] TO DISADVANTAGED COMMUNITIES. § 2.
