S T A T E O F N E W Y O R K ________________________________________________________________________ 8579 2021-2022 Regular Sessions I N A S S E M B L Y December 13, 2021 ___________ Introduced by M. of A. SALKA -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to prohibiting courses in critical race theory THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 817 to read as follows: § 817. COURSES OF STUDY IN CRITICAL RACE THEORY. 1. NO TEACHER, ADMINISTRATOR OR OTHER EMPLOYEE OF A SCHOOL DISTRICT, CHARTER SCHOOL OR CITY SCHOOL DISTRICT SHALL REQUIRE OR MAKE PART OF A COURSE THE FOLLOW- ING CONCEPTS: A. ONE RACE OR SEX IS INHERENTLY SUPERIOR TO ANOTHER RACE OR SEX; B. AN INDIVIDUAL, BY VIRTUE OF HIS OR HER RACE OR SEX, IS INHERENTLY RACIST, SEXIST OR OPPRESSIVE, WHETHER CONSCIOUSLY OR UNCONSCIOUSLY; C. AN INDIVIDUAL SHOULD BE DISCRIMINATED AGAINST OR RECEIVE ADVERSE TREATMENT SOLELY OR PARTLY BECAUSE OF HIS OR HER RACE OR SEX; D. MEMBERS OF ONE RACE OR SEX CANNOT AND SHOULD NOT ATTEMPT TO TREAT OTHERS WITHOUT RESPECT TO RACE OR SEX; E. AN INDIVIDUAL'S MORAL CHARACTER IS NECESSARILY DETERMINED BY HIS OR HER RACE OR SEX; F. AN INDIVIDUAL, BY VIRTUE OF HIS OR HER RACE OR SEX, BEARS RESPONSI- BILITY FOR ACTIONS COMMITTED IN THE PAST BY OTHER MEMBERS OF THE SAME RACE OR SEX; G. ANY INDIVIDUAL SHOULD FEEL DISCOMFORT, GUILT, ANGUISH OR ANY OTHER FORM OF PSYCHOLOGICAL DISTRESS ON ACCOUNT OF HIS OR HER RACE OR SEX; OR H. MERITOCRACY OR TRAITS SUCH AS A HARD WORK ETHIC ARE RACIST OR SEXIST OR WERE CREATED BY MEMBERS OF A PARTICULAR RACE TO OPPRESS MEMBERS OF ANOTHER RACE. 2. THE COMMISSIONER MAY ADOPT AND PROMULGATE RULES AND REGULATIONS AND TAKE ANY ACTION AS MAY BE NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. § 2. This act shall take effect immediately.
