 Introduced  by  Sens.  SKOUFIS,  MAY,  RIVERA  -- read twice and ordered
   printed, and when printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to providing informa-
   tion on where a list of violations and other actions taken against the
   facility can be found

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 2803 of the public health law is amended by adding
 a new subdivision 13 to read as follows:
   13. THE COMMISSIONER SHALL REQUIRE EACH RESIDENTIAL HEALTH CARE FACIL-
 ITY TO PROVIDE RESIDENTS AND THEIR FAMILIES WITH A SEPARATE DOCUMENT, AS
 PART OF AN INTAKE APPLICATION, IN NO LESS THAN TWELVE-POINT  FONT,  THAT
 INCLUDES  INFORMATION  ON  HOW  A  POTENTIAL  RESIDENT  AND THEIR FAMILY
 MEMBERS CAN LOOK  UP  COMPLAINTS,  CITATIONS,  INSPECTIONS,  ENFORCEMENT
 ACTIONS,  AND  PENALTIES  TAKEN  AGAINST  THE FACILITY INCLUDING THE WEB
 ADDRESS FOR THE NEW YORK STATE NURSING HOME  PROFILES  WEBSITE  THAT  IS
 MAINTAINED  BY THE DEPARTMENT AND THE NURSING HOME COMPARE WEBSITE MAIN-
 TAINED BY THE UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES,  IF
 APPLICABLE.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law.
