BILL NUMBER: S5601 SPONSOR: BORRELLO TITLE OF BILL: An act to amend the public officers law, in relation to prohibiting elected officers from publishing books about his or her time in office while still holding the position of such office PURPOSE: To prohibit elected officials from publishing a book that contains details about an office they are currently elected to. SUMMARY OF SPECIFIC PROVISIONS: Section 1: The public officers law in amended by adding a new section 73-c that all state officers and local officers shall be prohibited from publishing a book that contains details about such officer's time in office, if such officer still currently holds the position of such office.

BORRELLO -- read twice and ordered printed, and when printed to be committed to the Committee on Ethics and Internal Gover- nance AN ACT to amend the public officers law, in relation to prohibiting elected officers from publishing books about his or her time in office while still holding the position of such office THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public officers law is amended by adding a new section 73-c to read as follows: § 73-C. BOOK PUBLISHING BY STATE AND LOCAL OFFICERS; PROHIBITED. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, ALL STATE OFFICERS AND LOCAL OFFICERS SHALL BE PROHIBITED FROM PUBLISHING A BOOK THAT CONTAINS DETAILS ABOUT SUCH OFFICER'S TIME IN OFFICE, IF SUCH OFFI- CER STILL CURRENTLY HOLDS THE POSITION OF SUCH OFFICE. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10320-01-1

BILL NUMBER: S5601A SPONSOR: BORRELLO TITLE OF BILL: An act to amend the public officers law, in relation to prohibiting statewide elected officers and certain appointed officers from receiving compensation for any book or other published work written during the course of their term of service PURPOSE OR GENERAL IDEA OF BILL: Any officer elected to a statewide office within the state or state salaried positions filled by direct appointment by the governor and confirmed by the Senate is prohibited from selling or receiving compen- sation for any book or other published work written during their term of public service in such position. BORRELLO, OBERACKER, O'MARA, ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Ethics and Internal Governance -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public officers law, in relation to prohibiting statewide elected officers and certain appointed officers from receiv- ing compensation for any book or other published work written during the course of their term of service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 74 of the public officers law is amended by adding a new paragraph j to read as follows: J. NO OFFICER ELECTED TO A STATEWIDE OFFICE WITHIN THE STATE OR WHO HOLDS AN OFFICE FILLED BY DIRECT APPOINTMENT BY THE GOVERNOR, THAT RECEIVES A STATE SALARY, AND REQUIRES SENATE CONFIRMATION MAY SELL OR RECEIVE COMPENSATION FOR ANY BOOK OR OTHER PUBLISHED WORK WRITTEN DURING THEIR TERM OF SERVICE IN SUCH POSITION. THIS PARAGRAPH SHALL NOT PROHIB- IT SUCH A PERSON FROM SELLING OR RECEIVING COMPENSATION FOR ANY BOOK OR OTHER SUCH PUBLISHED WORK WRITTEN EITHER BEFORE OR AFTER SUCH TERM OF SERVICE. § 2.
