BILL NUMBER: S6041 SPONSOR: HINCHEY TITLE OF BILL: An act to amend the transportation law and the general municipal law, in relation to requiring highway projects that receive state funding to include the assessment and completion of any water infrastructure repairs and providing for access to such water infrastructure PURPOSE OR GENERAL IDEA OF BILL: Requires highway projects that receive state funding to include the assessment and repair of water infrastructure and provides for access to such water infrastructure. SUMMARY OF SPECIFIC PROVISIONS:. Section 1: Requires that an assessment and completion of water infras- tructure repairs or replacement is conducted anytime a road project that receives state funding takes place.

HINCHEY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the transportation law and the general municipal law, in relation to requiring highway projects that receive state funding to include the assessment and completion of any water infrastructure repairs and providing for access to such water infrastructure THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The transportation law is amended by adding a new section 23 to read as follows: § 23. WATER INFRASTRUCTURE ASSESSMENT AND REPAIR FOR CERTAIN HIGHWAY PROJECTS. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, ANY HIGHWAY PROJECT WHICH RECEIVES STATE FUNDING SHALL INCLUDE AN ASSESSMENT AND COMPLETION OF ANY WATER INFRASTRUCTURE IN NEED OF REPAIR IMMEDIATELY OR WITHIN THE NEXT FIVE YEARS. FOR THE PURPOSES OF THIS SECTION, THE TERM "WATER INFRASTRUCTURE" SHALL BE DEEMED TO INCLUDE ANY PIPES OR OTHER CONDUITS FOR DRINKING WATER, WASTEWATER AND STORM WATER. § 2. The general municipal law is amended by adding a new section 120-y to read as follows: § 120-Y. WATER INFRASTRUCTURE ASSESSMENT AND REPAIR. MUNICIPALITIES, IN CONSULTATION WITH THE DEPARTMENT OF TRANSPORTATION, SHALL ENSURE THAT ACCESS IS GRANTED TO ANY WATER PIPE OR CONDUIT INSTALLED PURSUANT TO THE PROVISIONS OF SECTION TWENTY-THREE OF THE TRANSPORTATION LAW. § 3. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10342-03-1
