TITLE OF BILL:

An act to amend chapter 53 of the laws of 2021, enacting the aid to
localities budget, in relation to repaying our Afghan allies

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill seeks to allocate $50 million for the resettlement of Afghan
refugees in the state.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 declares that this bill shall be known as the "Repaying Our
Afghan Allies Act."

Section 2 provides the legislative intent of the bill.

Section 3 allocates $50 million for the resettlement of Afghan refugees.

Section 4 marks the effective date.

 
JUSTIFICATION:

The unfolding crisis in Afghanistan as a result of the rapid pullout of
American troops and civilian personnel has increased the probability for
a large number of Afghan refugees resettling in America - and New York -
in an expedited manner. While the state of New York does not have a say
in the process of admitting refugees to our country, our state has
played an historically significant role in the resettlement of refugee
populations. In order to prepare for this potential influx, the state
must allocate additional resources to properly support efforts to reset-
tle refugees throughout New York.

The overwhelming majority of Afghans seeking to leave Afghanistan and
resettle in the United States have supported our country's effort in the
War on Terror, which developed after the devastating attacks on American
soil on September 11, 2001. These individuals have been - and will
continue to be - the target of reprisals on behalf of the Taliban. If
the federal government is to grant these individuals safety in the
United States, New York needs to be prepared to support their transition
so that they can be properly resettled.

EFFECTIVE DATE:
This act shall take effect immediately and shall be deemed to have been
in full force and effect on and after April 1, 2021.

 AN ACT to amend chapter 53 of the laws of  2021,  enacting  the  aid  to
   localities budget, in relation to repaying our Afghan allies
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. This act shall be known and may be cited as  the  "repaying
 our Afghan allies act".
   §  2.  As  a result of the United States' withdrawal from Afghanistan,
 thousands of Afghans who bravely assisted our service members in a vari-
 ety of roles, including as interpreters and guides, are now at  risk  of
 death  at the hands of the Taliban.  This bill is intended to be a small
 repayment from the people of New York of the debt our nation owes to our
 Afghan allies who now need to leave their homeland and make a  new  home
 in the United States.
   §  3. Section 1 of chapter 53 of the laws of 2021, enacting the aid to
 localities budget, is amended by repealing the items  herein  below  set
 forth  in  brackets and by adding to such section the other items under-
 scored in this section:

 For services  related  to  refugee  programs
   including  but  not  limited to the Cuban-
   Haitian and refugee  resettlement  program
   and the Cuban-Haitian and refugee targeted
   assistance  program  provided  pursuant to
   the federal refugee assistance act of 1980
   as amended.
 Funds appropriated herein shall be available
   for aid to municipalities and for payments
   to the federal government for expenditures
   made pursuant to the social  services  law
   and  the  state  plan  for  individual and
   family grant program  under  the  disaster
   relief act of 1974.
 Such  funds  are to be available for payment
   of aid heretofore accrued or hereafter  to
   accrue  to  municipalities. Subject to the
   approval of the director  of  the  budget,
   such  funds  shall  be  available  to  the
   office of temporary and disability assist-
   ance  net   of   disallowances,   refunds,
   reimbursements, and credits.
 Notwithstanding  any  inconsistent provision
   of law, funds appropriated herein, subject
   to the approval of  the  director  of  the
   budget and in accordance with a memorandum
   of  understanding  between  the  office of
   temporary and  disability  assistance  and
   any other state agency, may be transferred
   or  suballocated to any other state agency
   for expenses related to refugee programs.
 Notwithstanding any  inconsistent  provision
   of law, and subject to the approval of the
   director  of the budget, the amount appro-
   priated  herein  may   be   increased   or
   decreased  through transfer or interchange
   with any other federal appropriation with-
   in the office of temporary and  disability
   assistance (52304) .......................... 26,000,000
 FOR  SERVICES  AND  EXPENSES OF REPAYING OUR
   AFGHAN ALLIES. FOR THE  PURPOSES  OF  THIS
   APPROPRIATION,  REPAYING OUR AFGHAN ALLIES
   SHALL MEAN PROVIDING  ASSISTANCE  FOR  THE
   RESETTLEMENT  OF  AFGHAN  REFUGEES WHO ARE
   PART OF THE SPECIAL IMMIGRANT  VISA  (SIV)
   PROGRAM  OR  ANY OTHER PROGRAM ESTABLISHED
   BY THE  FEDERAL  GOVERNMENT  FOR  REFUGEES
   FROM  AFGHANISTAN  IN LIGHT OF THE TALIBAN
   TAKEOVER OF THE COUNTRY IN 2021.  NOTWITH-
   STANDING  ANY  INCONSISTENT  PROVISION  OF
   LAW, THIS APPROPRIATION SHALL BE USED  FOR
   GRANTS  IN  AID  OR  EXPENSES OF CONTRACTS
   WITH NOT-FOR-PROFIT AGENCIES TO BE  DETER-
   MINED  PURSUANT  TO A PLAN TO BE DEVELOPED
   BY THE OFFICE OF TEMPORARY AND  DISABILITY

PURPOSE:

This bill seeks to allocate $50 million for the resettlement of Afghan
and Ukrainian refugees in the state.

 
SUMMARY OF PROVISIONS:

Section 1 declares that this bill shall be known as the "securing and
assisting vulnerable evacuees (SAVE) act."

Section 2 provides the legislative intent of the bill.

Section 3 allocates $50 million for the resettlement of Afghan and

Ukrainian refugees.

Section 4 marks the effective date.

 
JUSTIFICATION:

Continued turmoil in Afghanistan due to the rapid pullout of American
troops and civilian personnel, coupled with the Russian invasion of
Ukraine has caused a significant flight of people from both nations.  As
a result, other countries throughout the world have been required to
assist in the resettlement of individuals and families who have been
displaced through no fault of their own, increasing the probability of a
large number of refugees resettling in America and New York - in an
expedited manner. While the state of New York does not have a say in the
process of admitting refugees to our country, our state has played a
historic role in the resettlement of refugee populations. In order to
prepare for the potential influx, the state must allocate additional
resources to properly support efforts to resettle refugees throughout
New York.

The overwhelming majority of Afghans seeking to leave Afghanistan and
resettle in the United States have supported our country's effort in the
War on terror, which developed after the devastating attacks on American
soil on September 11, 2001. These individuals have been - and will
continue to be - the target of reprisals on behalf of the Taliban. Addi-
tionally, the United States has established strong diplomatic relations
with the Ukrainian government since its independence from the Soviet
Union, aiding in the transition to a democratic state. Millions of our
Ukrainian allies have fled the nation as a result of the continued
targeting of civilian infrastructures by the recent Russian aggression.
If the federal government is to grant these individuals safety in the
United States, New York needs to be prepared to support their transition
so they can be properly resettled.

 significant  increase in the number of refugees that New York state will
 be taking in as a result of these ongoing situations.
   § 3. Section 1 of chapter 53 of the laws of 2021, enacting the aid  to
 localities  budget,  is  amended by repealing the items herein below set
 forth in brackets and by adding to such section the other  items  under-
 scored in this section:
