 Introduced  by  Sen.  RYAN  --  read twice and ordered printed, and when
   printed to be committed to the Committee on Consumer Protection
 
 AN ACT to amend the general business law, in relation to requiring  that
   the sale or delivery of body vests occur in person
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The general business law is amended by adding a new section
 396-eee to read as follows:
   § 396-EEE. SALE OR DELIVERY OF BODY  VESTS.  1.  NO  PERSON,  FIRM  OR
 CORPORATION  SHALL  SELL  OR DELIVER BODY VESTS TO ANOTHER PERSON UNLESS
 THE TRANSFEREE MEETS IN PERSON WITH THE  TRANSFEROR  TO  ACCOMPLISH  THE
 SALE OR DELIVERY.
   2.  THE  PROVISIONS OF SUBDIVISION ONE OF THIS SECTION SHALL NOT APPLY
 TO THE SALE OR DELIVERY OF BODY VESTS TO A SWORN  MEMBER  OR  AUTHORIZED
 OFFICIAL  OF  A LOCAL LAW ENFORCEMENT AGENCY OR OF THE DIVISION OF STATE
 POLICE, TO AN AUTHORIZED OFFICIAL OF A MUNICIPALITY OR  THE  STATE  THAT
 PURCHASES  BODY VESTS ON BEHALF OF A LOCAL LAW ENFORCEMENT AGENCY OR THE
 DIVISION OF STATE POLICE OR TO A MEMBER OF THE NATIONAL GUARD  OR  OTHER
 RESERVE COMPONENT OF THE ARMED FORCES.
   3. AS USED IN THIS SECTION, "BODY VEST" SHALL HAVE THE SAME MEANING AS
 IN SUBDIVISION TWO OF SECTION 270.20 OF THE PENAL LAW.
   4.  ANY  PERSON,  FIRM  OR CORPORATION THAT VIOLATES THE PROVISIONS OF
 THIS SECTION SHALL BE GUILTY OF A CLASS A MISDEMEANOR.
   § 2. This act shall take effect immediately.
