Provides that upon motion and after an opportunity to be heard, a court may order the defendant in a family offense proceeding to turn control of a connected device over to a family or household member or, if that is not possible, to have such connected device disabled by the manufacturer.

WOERNER -- read once and referred to the Commit- tee on Codes AN ACT to amend the criminal procedure law, in relation to transferring control of a defendant's connected devices in a family offense proceeding THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 8 of paragraph (a) of subdivision 1 of section 530.12 of the criminal procedure law is amended by adding a new clause (C) to read as follows: (C) UPON MOTION AND AFTER AN OPPORTUNITY TO BE HEARD, THE COURT MAY ORDER THE DEFENDANT TO TURN CONTROL OF A CONNECTED DEVICE OVER TO A FAMILY OR HOUSEHOLD MEMBER OR, IF THAT IS NOT POSSIBLE, TO HAVE SUCH CONNECTED DEVICE DISABLED BY THE MANUFACTURER. § 2.
