 AN  ACT  to  amend  the  public  health law, the mental hygiene law, the
   education law and the insurance law, in relation to including all  FDA
   approved  forms  and  doses  of  Naloxone as opioid antagonists in the
   state definition of opioid antagonists

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subparagraph  (i)  of  paragraph  (a) of subdivision 3 of
 section 3309 of the public health law, as amended by chapter 42  of  the
 laws  of  2014,  is  amended and a new subdivision 9 is added to read as
 follows:
   (i) "Opioid antagonist" means a drug approved by  the  Food  and  Drug
 Administration  that, when administered, negates or neutralizes in whole
 or in part the pharmacological effects of an opioid in the body. "Opioid
 antagonist" shall be limited to [naloxone and other medications approved
 by the department for such purpose] ALL  FORMS  AND  DOSES  OF  NALOXONE
 APPROVED  BY THE FOOD AND DRUG ADMINISTRATION. THE DEPARTMENT SHALL MAKE
 AVAILABLE ALL FORMS OF NALOXONE FOR SUCH PURPOSE IN ANY  FORMULATION  OR
 DOSAGE APPROVED BY THE FOOD AND DRUG ADMINISTRATION.
   9.  ANY PURCHASE OF, DISTRIBUTION OF, OR AUTHORIZATION TO PRESCRIBE AN
 OPIOID ANTAGONIST PURSUANT TO THIS SECTION SHALL ALLOW FOR CHOICE OF ANY
 FORMULATION OR DOSAGE APPROVED BY THE FOOD AND DRUG  ADMINISTRATION  AND
 MADE AVAILABLE BY THE DEPARTMENT.
   §  2.  Subparagraph  (ii) of paragraph 1 of subdivision (l) of section
 19.09 of the mental hygiene law, as added by chapter 434 of the laws  of
 2021, is amended and a new paragraph 4 is added to read as follows:
   (ii)  "Opioid  antagonist"  means  a federal food and drug administra-
 tion-approved drug that, when administered, negates  or  neutralizes  in
 whole  or  in part the pharmacological effects of an opioid in the body.
 The opioid antagonist shall be limited to [naloxone or other medications
 approved by the department of health for this  purpose]  ALL  FORMS  AND
 DOSES  OF  NALOXONE  APPROVED  BY  THE FOOD AND DRUG ADMINISTRATION. THE
 DEPARTMENT OF HEALTH SHALL MAKE AVAILABLE ALL FORMS OF NALOXONE FOR SUCH
