2023-A10356 - Summary

Directs that statewide resources and information relating to safe storage of firearms, child access prevention and firearm violence prevention and information on county and local specific laws and regulations related to child access prevention and the safe storage of firearms shall be provided to individuals at the time of issuance of a firearm license; directs the commissioner of the division of criminal justice services to develop and implement a public awareness campaign on the safe storage of firearms, rifles and shotguns and child access and prevention.

 AN ACT to amend the penal law and the executive law, in relation to  the
   safe storage of firearms and child access prevention
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Paragraph (c) of subdivision 18 of section  400.00  of  the
 penal law, as amended by chapter 371 of the laws of 2022, is amended and
 a new paragraph (d) is added to read as follows:
   (c)  any  other information necessary to ensure such licensee is aware
 of their responsibilities as a license holder[.]; AND
   (D) STATEWIDE RESOURCES  AND  INFORMATION  RELATING  TO  CHILD  ACCESS
 PREVENTION  AND  FIREARM  VIOLENCE  PREVENTION AS WELL AS INFORMATION ON
 COUNTY AND LOCAL SPECIFIC LAWS AND REGULATIONS RELATED TO  CHILD  ACCESS
 PREVENTION AND THE SAFE STORAGE OF FIREARMS.
   § 2. Section 265.50 of the penal law, as amended by chapter 133 of the
 laws of 2019, is renumbered section 265.46.
   §  3.  Article  35  of  the  executive  law is amended by adding a new
 section 847 to read as follows:
   § 847. PUBLIC AWARENESS OF SAFE STORAGE OF FIREARMS. THE  COMMISSIONER
 SHALL  CONDUCT  A PUBLIC AWARENESS CAMPAIGN TO EDUCATE THE PUBLIC ON THE
 SAFE STORAGE OF FIREARMS AND CHILD ACCESS PREVENTION. THE PUBLIC  AWARE-
 NESS  CAMPAIGN SHALL INCLUDE, BUT NOT BE LIMITED TO, EDUCATIONAL MATERI-
 ALS, RESOURCES AND INFORMATION RELATED TO NEW YORK  STATE  CHILD  ACCESS
 PREVENTION  LAWS  AND  LAWS  RELATING  TO  THE SAFE STORAGE OF FIREARMS,
 INCLUDING SECTIONS 265.45 AND 265.46 OF THE PENAL LAW, ANSWERS TO GENER-
 AL CONCERNS AND QUESTIONS THAT  INDIVIDUALS  HAVE  ON  SAFE  STORAGE  OF
 FIREARMS  AND  CHILD ACCESS PREVENTION, FIREARM VIOLENCE PREVENTION, AND
 COUNTY AND LOCAL SPECIFIC LAWS AND REGULATIONS RELATED TO  CHILD  ACCESS
 PREVENTION AND SAFE STORAGE OF FIREARMS.
   § 4. This act shall take effect immediately.

 SHOTGUNS INCLUDING SECTIONS 265.45, 265.46, AND 400.00 OF THE PENAL LAW,
 AVAILABLE METHODS FOR THE SAFE STORAGE OF FIREARMS, RIFLES AND  SHOTGUNS
 DESIGNED TO PREVENT CHILD ACCESS, FIREARM VIOLENCE PREVENTION RESOURCES,
 AND  COUNTY  AND  LOCAL  SPECIFIC  LAWS AND REGULATIONS RELATED TO CHILD
 ACCESS PREVENTION AND SAFE STORAGE OF FIREARMS, RIFLES AND SHOTGUNS.
