S T A T E O F N E W Y O R K ________________________________________________________________________ 10429 I N A S S E M B L Y May 24, 2024 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Peoples- Stokes) -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law and the social services law, in relation to mandatory health insurance coverage for follow-up screen- ing or diagnostic services for lung cancer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subsection (i) of section 3216 of the insurance law is amended by adding a new paragraph 39 to read as follows: (39) (A) EVERY POLICY WHICH PROVIDES MEDICAL, MAJOR MEDICAL, OR SIMI- LAR COMPREHENSIVE-TYPE COVERAGE SHALL PROVIDE COVERAGE FOR FOLLOW-UP SCREENING OR DIAGNOSTIC SERVICES FOR LUNG CANCER WHEN RECOMMENDED BY A HEALTH CARE PROVIDER ACTING WITHIN THE PROVIDER'S SCOPE OF PRACTICE PURSUANT TO TITLE EIGHT OF THE EDUCATION LAW. (B) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, ANY POLICY THAT PROVIDES COVERAGE REQUIRED BY THIS PARAGRAPH SHALL NOT IMPOSE PATIENT COST SHARING FOR FOLLOW-UP SCREENING OR DIAGNOSTIC SERVICES FOR LUNG CANCER. § 2. Subsection (l) of section 3221 of the insurance law is amended by adding a new paragraph 22 to read as follows: (22) (A) EVERY POLICY WHICH PROVIDES MEDICAL, MAJOR MEDICAL, OR SIMI- LAR COMPREHENSIVE-TYPE COVERAGE SHALL PROVIDE COVERAGE FOR FOLLOW-UP SCREENING OR DIAGNOSTIC SERVICES FOR LUNG CANCER WHEN RECOMMENDED BY A HEALTH CARE PROVIDER ACTING WITHIN THE PROVIDER'S SCOPE OF PRACTICE PURSUANT TO TITLE EIGHT OF THE EDUCATION LAW. Section 4303 of the insurance law is amended by adding a new subsection (vv) to read as follows: (VV) (1) EVERY POLICY WHICH PROVIDES MEDICAL, MAJOR MEDICAL, OR SIMI- LAR COMPREHENSIVE-TYPE COVERAGE SHALL PROVIDE COVERAGE FOR FOLLOW-UP SCREENING OR DIAGNOSTIC SERVICES FOR LUNG CANCER WHEN RECOMMENDED BY A EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
