 AN ACT to amend the vehicle and traffic law, in  relation  to  requiring
   that all for-hire vehicles have New York state license plates in order
   to receive a New York state inspection
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision (b) of section 301 of the vehicle  and  traffic
 law is amended to read as follows:
   (b)  (1)  The  commissioner  shall  also require the inspection of any
 motor vehicle duly registered under the laws of another state,  a  prov-
 ince of Canada, a territory or a federal district to the extent to which
 such  state,  province,  territory  or  federal  district  requires  the
 inspection of motor vehicles duly registered  under  the  laws  of  this
 state;  PROVIDED, HOWEVER, THAT A MOTOR VEHICLE USED TO CARRY PASSENGERS
 FOR HIRE IN FOR-HIRE VANS AND BUSES GREATER THAN NINE PASSENGERS CAPACI-
 TY HAVE NEW YORK STATE ISSUED LICENSE PLATES TO RECEIVE A NEW YORK STATE
 DOT INSPECTION A FOR-HIRE VEHICLE SERVICE UNDER AN AUTHORIZATION  ISSUED
 BY  A  MUNICIPALITY  SHALL  NOT  BE  INSPECTED  IN  ACCORDANCE  WITH THE
 PROVISIONS OF THIS SECTION UNLESS  SUCH  MOTOR  VEHICLE  USED  TO  CARRY
 PASSENGERS  FOR  HIRE IN A FOR-HIRE VEHICLE IS DULY REGISTERED UNDER THE
 LAWS OF THIS STATE.
   (2) FOR THE PURPOSES OF THIS PARAGRAPH, THE FOLLOWING TERMS SHALL HAVE
 THE FOLLOWING MEANINGS:
   (A) "FOR-HIRE VEHICLE" SHALL MEAN A MOTOR VEHICLE CARRYING  PASSENGERS
 FOR  HIRE IN THE CITY, WITH A SEATING CAPACITY OF TWENTY-FOUR PASSENGERS
 OR LESS, NOT INCLUDING THE DRIVER; AND
   (B) "SEATING CAPACITY" SHALL INCLUDE ANY PLAIN VIEW LOCATION WHICH  IS
 CAPABLE  OF  ACCOMMODATING  A  NORMAL  ADULT  AS PART OF AN OVERALL SEAT
 CONFIGURATION AND DESIGN AND IS LIKELY TO BE USED AS A SEATING  POSITION
 WHILE THE VEHICLE IS IN MOTION.
   § 2. This act shall take effect immediately.
